Senator Dino Melaye who participated in Kogi West Senatorial election on Saturday November 16, has demanded its cancellation after he stormed the national headquarter of the Independent National Electoral Commission (INEC) in Abuja with 21 video clips.

The Kogi Senator who was sacked by the Court of Appeal said the 21 video clips he presented to INEC secretary, Rose Orianran-Anthony and the national commissioner Festus Okoye documented electoral malpractices witnessed during the election.

AKA, South Africans jubilate as organizers cancel Burna Boy's concert in the country

Just days before Burna Boy was set to perform in South Africa, organisers have announced that he has been withdrawn and the concerts in Cape Town and Tshwane cancelled.
 
In a media statement issued today, organisers said that after extensive engagement with Burna Boy’s management team, they had decided to withdraw the Nigerian artist from the concert and cancel the shows.  
 
They said the decision to cancel the shows came after warnings of a shutdown from a group of artists and event organisers under the umbrella of Tshwane Entertainment Collective.

Quote:“The decision to cancel the Africans Unite Concert comes after the call from the Tshwane Entertainment Collective to boycott the Africans Unite concert in Tshwane.
With the increasing threats of violence from other unfortunate segments of the public and without any government intervention, Phambili Media and Play Network Africa were prompted to take the threats and warnings seriously, as the safety of all artists and attendees could not be guaranteed.
We then decided to cancel the concert. The safety of all attendees, artists and crew comes first.”

A divisional police officer (DPO) in charge of Mubi north, Ahijo Mujeli, has been kidnapped.
 
Spokesperson of the state police command, Suleiman Yahaya, who confirmed this to newsmen, said Myjeli was abducted along Mubi-Maraba road on Tuesday night.
 

Quote:“He was driving in his personal car around 6.30 p.m., along Mubi-Maraba road near the toll-gate when he was abducted. There was sound of shooting around the area, when our men arrived, they met an empty car identified as his. 
We are hoping of positive result and I want to use this opportunity to advise members of the public with relevant security information on criminals to avail the command same for necessary action” Yahaya said
 
Recall that in October, an assistant commissioner of police, Ismail Rambo, was kidnapped in Kaduna while he was on his way to Jos, Plateau state capital. He was released 48 hours later.

Two students were filmed having sex out in the open and the video has been shared online.
 
The lovers, who are allegedly Unilag students, were both pants down when they were caught. They were lying on the hard floor in a compound, having sex, when they noticed people filming them and they quickly stood up, picked their clothes, and went back inside.

  FCTA To Demolish 140 Illegal Structures In Abuja Communities

The Federal Capital Territory Administration (FCTA) has concluded plans to demolish no fewer than 140 illegal structures built on service corridors in Kuruduma II and Kpaduma II communities in Guzape District of Abuja. Mr Thompson Hope, Chief Town Planning Officer, FCT Department of Development Control, disclosed this while briefing newsmen shortly after inspecting the illegal structures on Wednesday in Abuja. 

Hope said that the department had earlier issued seven days ultimatum to the inhabitants of the affected illegal structures in the area, adding that as soon as the ultimatum expire on Monday Nov. 25, demolition would begin immediately.

He said that the development control had marked some of the illegal structures for demolition as far back as two, three years ago. He also said that the department had carried out several sensitise campaign to the indigenous communities for many years but they refused to abide by the FCTA regulations on land allocation.


 According to him, the indigenous communities and villages has expanded beyond the indigenous settlement and most of this expansion and illegal structures, the areas are been sold by the indigenous communities themselves.

He said that the department held several meetings with the leaders of the indigenous communities on the need for them to stop selling plots of land to the people. 


“We have severally warn the indigeous communities including the local chiefs that all the lands in FCT is vested within the confine of the FCT Minister and that they should desist from selling land. “But because some people are so desperate and desirous to build thinking that before government takes action they will either make one or two profits out of it.

“This illegal structures are already build on service corridors where plot allottees are desirous to develop their properties but because of this illegal development along the corridor they cannot take possession of their plots.


 “Recently, the FCTA has sent signals to plot allottees to take possession of their plots else they stand a chance of been revoke and that has put us under enormous pressure as a department. ” By our estimate, we have about 140 illegal structures on this corridors.

We have given them 7 days ultimatum and hopefully by the expiration of the ultimatum, we are coming to demolish all the illegal structures. 


” The notice was given to them on Monday Nov. 18 and it will expire by Monday Nov. 2. ”Hopefully on Tuesday, we will come with our machines to demolish them,” he said. On the issue of compensation to the owners of the illegal structures, Hope said compensation was a policy issue that can only be handled by the Minister.(NAN)

41yr old Mr Pascal Uba was killed by youths of Umuiwuogu community in Mbaitoli LGA, Imo State when he was caught trying to rape one Mrs Ebere who went to her farm.

Sources confirmed that the deceased has been behaving abnormal since his return from Lagos last three years.

The father of the deceased said he son is a labourer and has no previous report of stealing or rape.

According to him,no one came to report to him about the matter instead they laid siege for him in the night and killed him.

Mrs Gladys Uba, the mother of the deceased narrated she had already gone to the woman to apologise and pledge to take care of her bills.

In her words, my son was killed because they felt we are poor because he did not actually commit the offence.

The former lawmaker shared pictures of his time at the Arena on Twitter on Wednesday morning.

In his tweet, Saraki hoped that NBA games would be played in Nigeria in the near future as was done in South Africa in 2018.

Nigeria is Africa’s largest crude oil exporter and ranks among the top ten exporters in the world. The country’s economy remains heavily reliant on its oil sector as it is the main source of both government revenue and foreign exchange. Petroleum export accounts for c.70%-80% of revenues with several transmission channels into incomes and economic output.
Although the government has introduced a few policies in past years to diversify the Nigerian economy from its reliance on oil, the intended outcomes of those policies are yet to materialise- leaving the economy at the mercy of the volatile oil sector. Interestingly, the oil sector that wields so much power on the economy constitutes just about 9%-10% of the countryís GDP.
The Nigerian oil sector is no stranger to fire outbreaks, theft and sabotage from the Niger-Delta militia. The disgruntled militia in the Niger-Delta region often resort to vandalism as a way of getting government’s attention which ends up sabotaging the country’s economic progress. In 2016, one of such malicious attacks, alongside the slump in global oil prices, forced the country into its deepest economic downturn in over 30 years as the country’s crude output fell sharply from a peak of 2.2 million barrels per day (mbpd) to near 1 mbpd.

Recently, the operator of one of the country’s major oilfields, Aiteo, disclosed to Reuters that attacks on the Nembe Creek Trunkline ñ which produces about 150k bpd ñ resulted in the trunkline being shut down for 61 days this year. The Nembe Creek Trunkline, one of two that exports Bonny Light crude oil, has been shut down twice this year- once in April and the other in September.


The operator also added that over the last four years, more than 200 days of shut down have been recorded. The pipeline attacks have resulted in losses in crude production, culminating in deficits in revenue to all stakeholders- including the government who appears to be in desperate need of revenues to bridge its rising fiscal deficits.

Naturally, mono-product economies are exposed to fluctuations in the prices of underlying commodities. Often, the proceeds during periods of high prices are poorly managed, leaving weak buffers to cover periods of downturn in such commodity prices.


In our opinion, we believe reforms geared towards improving non-oil revenues are urgently required in improving fiscal buffers, strengthening domestic stability and insulating the economy from volatilities in crude oil prices. Looking ahead, we think the continued uncertainty around domestic crude production combined with the somewhat bleak outlook for global oil price in the long term should be a source of concern for policy-makers.

This information was disclosed by Minister of Mines and Steel Development, Architect Olamilekan Adegbite while speaking at an event that brought stakeholders in the sector together in Ekiti.


The Details: Giving details about the illegal sites, Adegbite noted that the government had been engaging mining operators in these communities to lure them into formally registered cooperatives for the purpose of safely mining the nation’s resources.

Adegbite words: “A total number of 1,759 Artisanal and Small Scale Miners, ASM, sites have so far been identified across Nigeria. With consistent interventions by the Federal Government through the Ministry of Mines and Steel Development 1,346, artisanal mining operators have been drawn into forming registered Artisanal Mining Cooperatives, AMCs, in readiness to access SmalI-scale Mining Licenses, SML.


“Each of the 1,346 mining cooperatives comprises over 10 members; with additional 20 mine workers for each cooperative.
It is a continuous process from the operators who have been organised into groups, they can come forward and apply for loans, it is not for us to go out and distribute money, everyone is aware that the money exists, people should come up with plans, cooperative bodies that are fully registered will be able to serve as guarantors to individuals. On the artisanal sites have been discovered like we did, we can approach them and teach them safer methods of mining,” he added.



In addition to continued engagements, Adegbite noted that the Ministry would pay attention to these communities while making sure they benefit from the Community Development Agreements in line with the provisions of the Nigerian Minerals and Mining Act, 2007.


What you should know: The government has been trying to revive the sector in recent times. As published by Nairametrics, Pedro Omontuemhen, a partner at PricewaterhouseCoopers disclosed that in some African countries, the contribution of mining to the GDP hovers around 15-25% but Nigeria’s contribution is less than 1%.

Photos shared online have drawn attention to the shocking state of Government Girls Science College, Agaie, in Niger state.
 
The girls' only college is in such a state of ruin that people are wondering how the students are able to cope under such conditions and still be expected to do well academically.
 
The photos show the sad state of the hostel where the girls sleep. The roof is already caving in, leaving parts of the dormitory open to the elements.
 
The rooms are in such a bad state that students have to strategically place buckets to catch rainwater that drops into the dormitory from the leaking roof.

Medics show off tar-blackened lungs after removing them from a 52-year-old man who had been a chain smoker for 30 years

The patient had signed up to donate his organs after death, but medics quickly realised they would not be able to use them.

Dr Chen, a lung transplant surgeon and also vice president of the facility, led the operation.

He said: 'The patient didn't undergo a CT scan before his death. He was declared brain dead, and his lungs were donated shortly after that.
'Initial oxygenation index tests were okay, but when we harvested the organs, we realised we wouldn't be able to use them.

'We Chinese love smoking. It would be impractical to say that we wouldn't accept the lungs of all smokers, but there are strict standards.

Professor Peter Openshaw, of the National Heart and Lung Institute, said the patient had been suffering from lung pulmonary emphysema.

It causes the organs to become severely inflamed and expand, and makes sufferers short of breath.

He said that medics may have also inflated the lungs with air or fluid prior to harvesting them for donation.

This makes them look much larger than the normal deflated lung postmortem, he explained.

Dr Chen uploaded the clip to social media with the hashtag 'jieyan' - Mandarin for 'quit smoking'.

He wrote: 'Many smokers in this country have lungs which look like this.

'Our team decided to reject these lungs for transplant. If you're a heavy smoker, your lungs may not be accepted even if you choose to donate them after death.

According to a 2018 study by China's Center for Disease Control and Prevention, 350million adults (27 per cent) are smokers.

People are drawn to smoking because nicotine can make them feel good, but it's easy to become addicted and very difficult to quit once smoking becomes a habit.

Smoking kills 1.2million people every year and people who do it are twice as likely to have a heart attack and up to 30 times more likely to get lung cancer.

FBI-wanted fraudster Emmanuel Oluwatosin forfeits house, cars, bags prison term

Emmanuel Adedeji Oluwatosin, an FBI-wanted scammer was convicted on Tuesday, November 19th by Justice M S. Sifawa of the Sokoto State High court sitting in Sokoto, over $150,000 internet fraud.
 

Upon arraignment, Adedeji pleaded guilty to the charge.  In view of the defendant’s plea, the prosecuting counsel, Musa. Mela Gwani asked the court to convict and sentence the defendant.

Quote:The charge reads, “that you Adedeji Emmanuel Oluwatosin, sometime between January and July 2019 at Sokoto within the jurisdiction of the Sokoto State High Court did steal the sum of $150, 000.00 (One Hundred and fifty Thousand Dollars) through wire funds transfer from multiple foreign victims by fraudulent intrusion into their retirement accounts domiciled in United States of America via internet and transferred the said sums into fraudulent business accounts created by you and you withdrew the said funds through ATM Cards and cashier cheques and you thereby committed the offence of Theft contrary to Section 274 of the Sokoto State Penal Code Law 2019 and punishable under Section 275 of the same Law”.
 
However, the defence counsel, Shamsu A. Dauda, pleaded with the court to temper justice with mercy as his client was a first time offender who has become remorseful. He also told the court that the convict is ready to restitute the victims by forfeiting his home in Kaduna and two Mercedes Benz cars (Models C550e and C450) to the victims.

Justice Sifawa, thereafter convicted and sentenced the defendant to two (2) years imprisonment with option of Two Million Naira (N2, 000,000.00) fine. He ordered the convict to restitute the victims by forfeiting the proceeds of the said crime: a residential apartment situated at No17/19 Seamans Street, Maigero, Kaduna State and two Mercedes Benz Models C550e and C450 respectively through Asset Forfeiture Unit of the EFCC for disposal and return of the proceeds to the victims of the offence through the US Legal Attaché in Nigeria.    
The convict’s journey to prison started on the 29th of August, 2019 when he was arrested in Kaduna at Unguwan Maigero in a luxury apartment, following intelligence by US Federal Bureau of Investigation (FBI) on his involvement in internet scams. Items recovered from the residence included two cars (Mercedes Benz C550e, Mercedes Benz C450), an IPhone, laptops, a modem and SIM cards. Wilson Uwujaren

Former President Olusegun Obasanjo who spoke at a two-day interactive session of the Presidential Youth Mentorship Retreat held at the Youth Development Centre in Olusegun Obasanjo Presidential Library, Abeokuta stated that he would continue to raise the alarm when things are not done properly in the country.
 
The elder statesmen said the fear of death won't deter him from speaking up against anomalies witnessed across the country. 
 
Obasanjo averred that he shouldn't be afraid of death at his age as he urged the visiting youths to sacrifice themselves individually and collectively to make Nigeria a great nation.

Nigerians woke up today to numerous sexually explicit videos, one of which shows a girl vigorously scrubbing her private part with pepper, and Twitter users are reacting in shock.
 
In the video, the girl is seen sitting on a bowl filled with fresh pepper. She grabbed a handful of the shredded pepper and used it to scrub her lady parts repeatedly while someone filmed. Another person can be heard laughing in the background.

Some Twitter users said she took the phrase "pepper dem" literally and others said she was trying to be "hot" for her boyfriend."

On Tuesday, November 19th, Dutch authorities found 25 migrants, UK bound, stowed away in a refrigerated container on a cargo ferry bound for Britain shortly after it left the Netherlands.  
 
The vessel quickly returned to the Dutch port of Vlaardingen, emergency services said. Two of the migrants were taken to hospital for treatment while the other 23 received a medical check-up in the port before being taken away by police for processing, according to a statement posted on the website of regional emergency services.  
 
The origins of the migrants is not known, and images of the stowaways being led to buses show mainly young men. Authorities found the migrants in the refrigerated container on a truck aboard the ferry, the statement said.
 
Police told Dutch national broadcaster NOS that they had detained the driver and he was being questioned over his possible involvement in human trafficking. The migrants were aboard a Britannia Seaways ferry owned by Danish operator DFDS (DFDS.CO) that had just embarked on a run across the North Sea to Felixstowe in southern England.  
 
Recall that on October 23, 39 bodies, all believed to be Vietnamese migrants, were discovered in the back of a refrigerated truck near London. Two people have been charged in Britain and eight in Vietnam over the deaths. The container in which the bodies were found had arrived on a ferry from Zeebrugge in Belgium.

“The role you played during the last elections showed that when you give your support, you give your support. People should be known for something. If you give your word, you give your word. In my entire political career, I have seen that when Okrika people say they want to do something, they will do it. You are different and I commend you, “ he added.

The governor warned the people against bearing arms, saying that it negates the principle of peace.

To him, the only reason why people get arms was because the “Nigerian Army is now part of elections in Nigeria.”

He charged the monarch to use his position to promote peace and development in Okrika and appealed to him to carry all interest groups along.

Wike explained that the state government would approach the House of Assembly for the amendment of the name of the stool to read: “the Amanyanabo of Okrika “ as requested by the traditional ruler.

Responding, King Alfred Sementari Abam congratulated the governor on his re-election and confirmation of his victory by the Supreme Court.

He said his return was on account of his outstanding performance and projects’ delivery.

The monarch also thanked the governor for the recognition granted his stool after the court judgment.

The family of embattled leader of the Islamic Movement in Nigeria (IMN) Ibraheem El-Zakzaky, has alleged that they have been extorted and exploited in order to get medication across to him.
 
The IMN leader's brother, Badamasi Ya’akub who spoke at a press conference in Abuja slammed the Department of State Service (DSS) over its comment of El-Zakzaky and others opting to remain in its custody instead of prison. 
 

Quote:“Last Friday the 15th of November, another statement was released by a public relations officer of the State Security Service in which justifications were offered for the continued illegal detention of what they referred to as notable Nigerians,” he said.
“With the names of Sheikh Ibraheem El-Zakzaky, Colonel Sambo Dasuki and Omoyele Sowore were specifically mentioned.
“The claim is that the SSS runs what can be best described as 5 star level of accommodations of international standards, for its illegally detained detainees; at the detainee’s explicit request.
“Detention centres that are preferable to all forms of correctional centres; designed to host alleged criminals. According to them, these imprisoned individuals have food and water provided by their families. Gymnasium facilities to exercise with and keep in shape.
“The facilities provide access to people and phones for communication, daily newspapers and television to remain up to date, and pristine and prompt medical facilities to ensure standard healthcare and welfare in accordance with international standards. All these luxuries are of a matter of course at the Service’s expense; which is to say at Nigerian’s expense.
“This is yet another in a long line of outlandish claims made by the ‘Service’ to justify its documented role as enforcers of law-breaking in the service of this lawless administration, led by President Muhammadu Buhari.”
 
Badamasi also alleged that his family has had no phone contact with his brother since he returned from his unsuccessful Indian medical trip. 
 
Quote:“No phone contact has been had with Sheikh Zakzaky since their return from the aborted medical trip in India. Sheikh Ibraheem El-Zakzaky receives no daily newspapers of any kind at any time regularly or irregularly,” he said.
“With Certainty, I can say that the last time he saw a functional Television screen was in his house in December 2015 before it was attacked and demolished by the 1st division of the Nigerian Army. As for the gymnasium and other 5-star level amenities mentioned by the ‘Service’. All if any are paid for by El-Zakzaky himself.
“We have been extorted and exploited to keep our flesh and blood as safe as much as we can. But the straight truth is that they can’t read newspapers, they have no access to TV, it takes mountains of hurdles for us to see them, and we pay a ransom worth of money to just send medical supplies through.
“Critically there is no phone. Every time an arm of the administration claims to have spent a certain amount; it is more than over thrice what we have spent.
“We will be readying some LCD TVs, subscribing to Daily Newspapers deliveries, Phone handsets with multiple SIM slots, SSS family request service and refund programmes, so the millions extorted can be proven to have not been spent in vain.”

Ovuomarhoni Naomi Isioro and her husband, Rowley Isioro, a former Assistant General Manager with one of the first generation banks were docked on Tuesday, November 18th by the EFCC for money laundering offences.  
 
At the end of proceedings, they were sent to a correctional centre in Lagos until 10 December, when the court will hear their bail application.
 
The Isioros and their companies, Multaid Plus Limited and Global Investment Network are facing a a seven-count charge bordering on conspiracy to commit felony, receiving fraudulently obtained property, transfer of criminal proceed to nominee and money laundering to the tune of $975,424.
 
Their trial is before Justice Mojisola Dada of the Special Offences Court sitting in Ikeja, Lagos. The defendants allegedly received monies suspected to be proceeds of illegal activities of one Michael Uziewe (at large) who was based in the United States of America with the aim of assisting him launder the funds in Nigeria.  
 
The defendants were said to have used the accounts of their companies domiciled in the bank where the second defendant, Rowley Isioro was an Assistant General Manager to launder the funds for Michael Uziewe. Both defendants pleaded not guilty to the charge preferred against them by the EFCC.

Quote:One of the counts reads: “That you Ovuomarhoni Naomi Isidoro, Rowley Isioro, Marhoni General Services Limited, Multaid Plus Limited, Michael Uziewe (at large) and Global Investment Network sometime in 2016, at Lagos within the jurisdiction of this Honourable Court conspired amongst yourselves to launder money which represents proceeds of illegal activities of Michael Uziewe in the United States of America.”  
Another charge reads: ”That you Ovuomarhoni Naomi Isidoro, Rowley Isioro, Marhoni General Services Limited, Multaid Plus Limited, Michael Uziewe (at large) and Global Investment Network sometime in 2017 at Lagos within the jurisdiction of this Honourable Court laundered an aggregate sum of $975,424 on behalf of Michael O. Uziewe (at large) and Global Investment Network through your bank accounts in order to disguise the origin of the money which represents proceeds of illegal activities of Michael O. Uziewe in the United States of America.” 
Upon their pleas, prosecution counsel, M.A. Bashir asked the court for a trial date and to remand the couple in a Correctional Centre. The counsel to the defendants, Sam Imoisini informed the court that he had filed applications for bail of his clients, and served the prosecution.  
 
Justice Dada adjourned the case till December 10, 2019 for hearing of bail application and ordered the remand of the couple at the Correctional Centre pending the determination of their bail applications.

RHAPSODY OF REALITIES

WEDNESDAY, 20TH NOVEMBER.


TRUST THE EXTRAORDINARY STRATEGIST

For unto us a child is born, unto us a son is given: and the government shall be upon his shoulder: and his name shall be called Wonderful, Counsellor, The mighty God, The everlasting Father, The Prince of Peace (Isaiah 9:6).

In the original Hebrew rendering of the underlined portion of the scripture above, there’s no punctuation between the words “Wonderful” and “Counsellor.” Moreover, the Hebrew word translated “wonderful” actually means mighty acts and deeds; miraculous works that cause wonder.

Also, the word, “Counsellor” in the Hebrew, doesn’t mean someone who’s giving you a piece of advice; it refers to one who counsels you for battle; a strategist. It thus refers to the Holy Spirit being our extraordinary strategist! Hallelujah!

It doesn’t matter where you are in your life today or what’s in front of you; you can always know what to do to win, if you’d consult the extraordinary strategist. He lives in you.

This is what makes us invincible! How can you fail when the extraordinary strategist lives in you! You only need to take advantage of His presence and ministry in your life.

Another interesting phrase in our opening scripture is, “The mighty God”; EL GIBBOR, and this is talking about His greatness, His superior Almightiness! In Jeremiah 32:27, He said, “Behold, I am the LORD, the God of all flesh: is there any thing too hard for me?” Absolutely nothing!

It makes no difference how hopeless the situation may seem; He knows what to do. He’s never confused, even when you seem flustered. He knows the way out of every crisis you face. He knows how to make you a success. He has the best strategies for your business, your job, your ministry, and your finances. All you need is to depend on Him for direction. Follow His Word and the counsel He gives you from within.

PRAYER

Dear Father, thank you for granting me all the treasures of wisdom and knowledge which are in Christ. I’m sagacious and I win all the time, because I play by the strategies of the Spirit. My life, ministry, family and business are flourishing exceedingly, in Jesus’ Name. Amen.

The incident happened on Monday, November 18, on the Long Bridge end of the Lagos-Ibadan Expressway in Ogun State, according to reports.

“We came to the conclusion that our transactional portal as it is run today is not suitable to the current context in Cameroon,” Jumia said in a statement to announce that its e-commerce operations in that country had been suspended.

However, the company said it would continue supporting buyers and vendors in Cameroon using its classified portal Jumia Deals.

The shut-down of its Cameroon operations makes it the third African country in which Jumia has folded up operations. It had earlier closed shop in Gabon and Congo Republic.

Meanwhile, a source at the company in Cameroon told Reuters that Jumia had chosen to prioritize growth over profitability; a move that had back-fired.

“We wanted to see how the business evolved. We can come back, but for now we’re closing to have time to study the market,” the source; who chose to remain anonymous, disclosed to Reuters.

The announcement of the suspension of its operations in Cameroon sent Jumia’s share price tumbling. Specifically, the shares hit a record low of $4.96.

Meanwhile, analysts and e-commerce watchers have reacted with dismay and shock to the Jumia shut-down in Cameroon. There are concerns that the same issues that had plagued Jumia in the three African countries it closed shop in were still ever-present in its other operational locations.

‘The Jumia strategy is one that has serious question marks hanging over it,’ disclosed Bode Akinpelu, an e-commerce enthusiast. ‘It has consistently prioritized growth over profitability and this has been touted as the reason for its failure in Cameroon. But the problem is the same in other countries in which Jumia operates, including Nigeria.

‘In fact, no one knows where the next shut-down will happen. It could be Nigeria, its biggest market or Ghana or Egypt. The situation is approaching critical, especially when one considers the impact on its investors, merchants, staff, creditors, suppliers and other stakeholders in the markets where Jumia folds up without warning.’

Jumia Technologies AG is a German-based e-commerce outfit. It was founded in 2012 in Berlin, Germany, and shareholders include the Berlin-based incubator and venture-capital firm Rocket Internet SE. Hassan said the election claimed the lives of no less than “10 citizens who died in various shooting incidents and attacks” across the state.

“Elections which would have enable everyday citizens express their democratic preferences were violently and crudely undermined by an unrelenting band of partisan outlaws,” she said.

“At the CDD Election Analysis Centre (EAC) in Kogi and Bayelsa from where we received field data and updates on the conduct of the polls, the sheer magnitude of the violent assault on the sanctity of the ballot was shocking beyond description. The outcome of a process that was so criminally subverted should not be allowed to stand.

“In clear terms, these incidents combined to damage the credibility of the polls.”

ICPC uncovers N18.62bn scam and gross abuse of personnel budget by some Federal Ministries

The Independent Corrupt Practices and other Related Offences Commission (ICPC) says it has uncovered gross abuse of personnel budget and inflation as well as padding of nominal role by some Federal Ministries, Departments and Agencies (MDAs) amounting to N18.62 billion.  

 

Chairman of the ICPC, Prof. Bolaji Owasanoye, made the disclosure at the National Summit on Diminishing Corruption in the Public Sector and presentation of integrity awards, organized by the Office of the Secretary to the Government of the Federation in collaboration with ICPC, in Abuja on Tuesday, November 19th.

 

According to him, the discovery of the scam followed the launching of the commission System Study and Review of MDA Practices, involving over 300 MDAs.

Quote:He said: “as at the time we went to press we had covered about 300 MDAs and the amount inflated was about N12billion. As at today your Excellency we have discovered additional N6b making a total of N18.624b restrained by ICPC.  
“The exercise is still ongoing but we can confidently report that culprit MDAs are mostly academic and health institutions. For example, preliminary findings show the following –  
“University of Benin Teaching Hospital N1.1billion; Federal Medical Center, Bayelsa N915million; Nnamdi Azikwe University N907million; University of Jos N896million; University College Hospital Ibadan N701million; Usman Dan Fodio University N636million and University of Ibadan N558million.  
“These institutions and all those implicated will be given the opportunity to explain themselves however, while investigations are on to confirm any credible explanations they may have, we have alerted the Minister of Finance of our findings and appropriate steps are being taken to ensure that implicated MDAs will not be able to spend the excess built into their personnel budget.  
“Let me note with regret sir that in the 2017-2018 fiscal year the balances recorded for personnel were wrongfully utilized by MDAs for other purposes due to lack of proactivity by late enforcement and related agencies. That sum amounted to N18.39b.’’

In light of these findings, the ICPC Chairman stressed the need for full implementation of the presidential directive that MDAs not on IPPIS should not be paid as the commission’s review had shown that most of the guilty MDAS were not on IPPIS.

Quote:He added: “In a similar vein, we found that some MDAs spent N9.2billion of capital funds on overhead related items contrary to extant financial regulations. We found to our surprise that some MDAs fail to remit tax and divert pension and NHIS deductions for unrelated payments thus aggravating the sufferings of other Nigerians.  
“Some MDAs abused the e-payment policy of government thus making payments through staff accounts instead of to actual beneficiaries. Most egregious in the current cycle of review is the Federal Ministry of Water Resources where N3.3billion was paid out in about a month through the accounts of staff. ICPC arrested 59 directors from the ministry and investigation is ongoing.’’

“Supposing I was dead after 2016 and somebody tells me that my son Philip will organise people to attack my house or to attack my village, to disrupt the convocation, maybe my body will be turning in heaven and I will not believe but the fact that I’m alive to see someone who did not win his own (polling) booth because his own people in his own village in his own community of Jattu did not want him because they apparently know him better than I do. But I stood by him, I stood for him and he became the deputy governor.
“If all that transpired now is to use that power to humiliate me but God didn’t allow it. As you can see, who can fight the battle? It is only God so I leave the burden of guilt to them and I will not repay evil with evil.
“I will stand on the path of peace, I will stand on the path of unity. I will stand on the path of justice because I know that God in heaven will never allow the evildoer to prevail.”

A final year student of Federal Polytechnic, Oko, and her boyfriend were found dead in a room off-campus days before she was to write her final paper.
 
According to a student of Fed Poly Oko, Chioma's boyfriend, popularly known as De Young, paid her a visit in school last Saturday, November 16, 2019, and they allegedly spent the day together in a friend's room.
 
A student of the school who spoke to LIB said De Young's friend, who left his room for them, returned the following morning, November 17, to find his room locked. When he knocked and no one opened, he peered through the window and saw De Young and Chioma scantily clad and motionless.

He forcefully opened the door and found them unconscious. Chioma's body was swollen and her tongue was sticking out of her mouth. Her skin colour had already changed.
 
They were rushed to "Chinonso Hospital" where it was revealed that Chioma, who is from Nnewi, had been dead for at least 6 hours but De Young was still alive, though unconscious.
 
People were hoping for his recovery so he would explain what had happened. Sadly, he eventually passed on too.
 
Chioma's was looking forward to writing her final exam on Friday, November 22, and she took to her Facebook Stories to write about it.

Friends and students have taken to various social media platforms to mourn Chioma, who has been buried, and De Young.

Recall that the Independent National Electoral Commission, INEC, had on Monday declared Governor Yahaya Bello of the All Progressives Congress, APC, winner of the Saturday’s governorship election in the state.

INEC’s Returning Officer in the state, Prof. Ibrahim Garuba had declared Bello winner after polling 406,222 votes to defeat his closest rival, Musa Wada of the Peoples Democratic Party, PDP, who scored 189,704 votes.

Prosecutors say the first allegation dates back to 2017, when the parents of a six-year-old girl living in the southwestern town of Jonzac accused him of raping her. He's also accused of raping a young relative, sexually assaulting another young relative and abusing a young patient.
 
The second set of accusations comes after police found a diary in his house where he recorded sexually explicit details of his assaults and escapades with about 250 minors. In the diary he wrote down the names of the minors which helped police track down the victims and get their testimony.
 
Scouarnec's lawyers claim the stories are mere fantasies but 184 people, 181 of whom were minors at the time of the alleged assaults, have filed formal complaints against him, in what could potentially be France's biggest case of paedophilia. Police also found child pornography and sex toys in his house.
"They remember perfectly well what they endured but never talked about it because they were afraid," Francesca Satta, a lawyer for some of the former surgeon's alleged victims, told AFP.
 
Scouarnec faces up to 20 years imprisonment if convicted on the first set of charges.

In an interview with Sahara Reporters, the victim, Boluwatife Adekunle, said she was assaulted by her colleagues for revealing how one of their boyfriends tried to have an affair with her.

I and one of the ladies in the video called 'Faith' were roommates in a hostel outside campus. Her boyfriend began asking me out but I felt it was not proper for me to date him. Before then, I had been having some issues with Faith as she had been living a wayward life on campus which I didn't like.
“From that point, she started seeing me as talking bad about her to people around our area. During this period, her boyfriend kept pestering me to date him but I refused. Instead of Faith to caution her boyfriend, she accused me of planning to sleep with her man. On the day that I was assaulted, she invited me to a room in one of the hostels and boyfriend and other ladies were inside the place already.
“Immediately I entered the place, they locked the door and asked me to kneel down while the guy was asking if he ever asked me for a date. Since I refused to kneel down, they began to beat me and also tried to strip me naked. They used a stick to hit me on my head and punched me on my face. The guy used horse whip to flog me several times.
“They said they would make sure they disgraced me on campus, I pleaded with them but they refused and I was about to faint when they stopped beating me. As I speak, I feel pains all over my body due to the beatings. Their plan was to kill me. I want them arrested and face the consequences of their action.”

He said claims by some individuals that they were at DSS to take Sowore’s delivery without seeing officials of the service was not true.  Afunanya said the service would not release Sowore to miscreants, protesters and persons who were not qualified to stand for proper documentation for his release.

Three more Nigerian nationals arrested for entering India illegally from Bangladesh in a night bus

East Jaintia Hills Police have arrested three more Nigerian nationals for entering India illegally through Bangladesh, the Meghalaya Police, said on Monday, November 18.
 
The district SP, Vivekananda Singh, said that on November 15 around 12.30 am, the three African nationals were detected by Ratacherra CP staff while travelling in a night super bus (AS-01-KC-0299) from Agartala to Guwahati.
 
They were detained for interrogation but since they could not produce valid documents to support their entry into India, they were arrested.
 
The case has been registered at Lumshnong PS and an investigation has been launched into the matter.

Bangladesh border is fast becoming a entry point for Nigerian citizens to enter India illegally. With these arrests, East Jaintia Hills Police have arrested a total of twenty-two Nigerians in the past two months alone.
 
Meghalaya police chief R Chandranathan said, “We are taking this case very seriously. All ramifications and possibilities are being probed”.
 
The probe has unraveled vital leads, like all the Nigerian citizens who were travelling in groups belong from the southern zone of the country, which is Christian dominated. Bangladeshi agents in Nigeria are responsible for their travel and itinerary who also might have helped facilitate their cross into India.

The latest report of Narcotics Control Bureau (NCB) revealed that Nigerians constituted about 40 percent of foreigners arrested for drug crimes in India during 2017.
“If they are able to earn money through fraud, they might return through the same route to Bangladesh after making provisions for the transfer of the amount. And if they are convicted for crimes, then they would serve the jail sentence and then get deported. It’s a risk worth taking for them,” claimed a middle-rung official of Directorate of Revenue Intelligence (DRI).
 
However, what concerns Indian security agencies is that the Nigerian nationals went unnoticed and were apprehended 200 kilometres into Assam and Meghalaya.
The development also establishes the existence of safe routes that facilitate the movement of people and commodities across the border and raises serious national security implications.

A 9-year-old Nigerian boy has told the sad story of how his teacher constantly defiled him and his other classmates, leaving him with a bleeding anus.
 
Facebook user, Diana Mary Nsan, who shared the story online, said the teacher's evil act came to light after the 9-year-old boy was seen bleeding from his anus by his nanny who then informed his parents. The parents questioned him and he told them what the teacher has been doing to him.
 
Diana also shared a video of the little boy recounting how the accused teacher repeatedly defiled him and his classmate. The little boy narrated how the teacher would always force him to his apartment within the school premises to rape him and how the teachers he complained to never listened to him.

Senator Dino Melaye has described what Kogi State elections on Saturday, November 16th as a civil war and not an election.  
 
Melaye, who contested for the Senatorial seat for Kogi West District which was declared inconclusive, said the Kogi ‘civil war’ claimed 16 lives. He said he would report Yahaya Bello, Smart Adeyemi, Sunday Faleke and others to the international community and then proceed to Hague.

Pastor Sunday Egbo, the General Overseer and founder of Christ Mercy Ministry in Ajuonu community of Obukpa, Nsukka Local Government Area of Enugu State has been paraded by the police alongside items recovered from his house. 
 
The Pastor met his waterloo after raping a female member who had come for prayers, a crime he reportedly confessed to.

The Department of State Services DSS, today said they fear publisher and convener of Revolution Now protest, Omoyele Sowore, might be knocked down by a moving vehicle if he is released from their custody, Sahara Reporters reports.
 
Sowore has been in DSS custody despite fulfilling his bail conditions. There have been various demands by the civil society groups and other Nigerians for the agency to respect the rule of law and release Sowore since he has fulfilled his bail conditions. 
 
Speaking at a press briefing in Abuja this morning, the spokesperson for the agency, Peter Afunanya, said Sowore's lawyer, Femi Falana (SAN), was yet to come to its office to receive Sowore.

The DSS spokesperson noted that Falana had not been to the headquarters of the service since the activist was granted bail, a claim the popular rights lawyer vehemently rejects.

Following the order of Justice Chuka Austine Obiozor of the Federal High Court, Lagos, the Assets Management Corporation of Nigeria took over two properties belonging to a former Minister of State for Defence, Ademola Seriki, in Lagos and Abuja over an outstanding staggering indebtedness of nearly N1billion.
 
Jude Nwauzor, Head, Corporate Communications, AMCON, in a statement on Monday, November 18th said the properties were located at No. 1a & 1b, Jalupon Close, Surulere, Lagos and No. 4, Djibouti Crescent, a high-brow area of Wuse 2, Abuja.
 
He said the case between AMCON and Seriki ended up in court as all efforts made by the corporation to resolve the issue peacefully did not yield the desired result.

A man is lucky to be alive after his gas exploded and parts of his body were burnt in the fire. He went on to narrate all the challenges he faced while trying to get immediate medical treatment.
 
Mr Vwokay said: "Lagos and Nigeria will kill you with your money and there is nothing you can do about it."
 
He narrated how he called a friend to help take him to the hospital but she was held up in traffic and arrived late. When she eventually arrived to drive him to the hospital, the journey that should have been 5 minutes ended up taking 30 minutes because of the bad road.
 
On getting to the hospital, the nurse was clueless and had no idea what to do. He had to wait for the doctor. The doctor also delayed for about 7 minutes before attending to him.
 
Mr Vwokay said at some point during his ordeal, it dawned on him that if his condition was life-threatening, he would have died a long time ago due to the poor state of things in the country.
 
He added that it's better to live as a second-class citizen in a racist foreign country because you will, at least, have access to "basic health amenities and an organized system".

Ten corpses were burnt in a fire outbreak that occured at the morgue of the Anatomy Department, Obafemi Awolowo University, Ile Ife, Osun State today November 19th. The corpses were being used by the students of the department for their practicals.

Shortly after the Independent National Electoral Commission (INEC) announced the candidate of All Progressives Congress (APC) winner of Kogi governorship election, political thugs continued on their killing spree.
 
According to reports from Kogi, the woman leader of Wada Aro Campaign Council, Ochadamu Ward, Hon Mrs Acheju Abuh was reportedly burnt alive in her home by alleged jubilant supporters and thugs said to be celebrating their party’s victory.
 
Reacting to the evil act, the spokesman, Wada/Aro Campaign Council, Faruk Adejoh-Audu was quoted saying “chanting GYB 4+4, the thugs, shooting sporadically, arrived Hon (Mrs) Abuh’s house at about 2pm this afternoon and surrounded the house, bolting every exit and escape from outside".

”This is to inform the Nigerian Embassy, that Mr. Arthur Oge Nwabufo a cadet from the Far Eastern State Technical Fisheries University is currently sailing on board sail training ship “Pallada” on the Round the World Expedition and he is the only Nigerian among cadets and crew-members of the sail ship,” it read.

Nwabufo is the younger brother of Fredrick Nwabufo, Nigerian journalist and columnist.

There was drama in the Itire-Ikate area of Surulere, Lagos State, on Friday, November 8, 2019, as hoodlums invaded some streets and vandalised over 200 vehicles belonging to residents.

According to the residents, the vandalised vehicles were parked on Bashorun, Shobande, Ogunsami, Ogunmuyiwa, Oredola, Lagos, Oshiga, Salami Bashorun and adjoining streets under the Oredola Community Development Association.

PUNCH Metro gathered that there was a crisis was between hoodlums from Shobande and Wosilat streets, as they stormed the area around 11.30pm on Friday and allegedly used cutlasses and hammers to smash the windscreens of vehicles parked on streets in the area.

It was learnt that the hoodlums, who wore masks, also took advantage of the tension in the area to rob unsuspecting members of the public of their valuables during the operation.

A mechanic in the area, Amuda Olisa, said the crisis was between two factions of hoodlums in the community, adding that two vehicles belonging to his customers were vandalised.

He stated, “On Friday, around 11.30pm, the hoodlums invaded the area and started breaking the windscreens of vehicles that were parked on the streets. They carried out the operation till 1am, but when the police came, they had already vandalised a lot of vehicles. The boys are from Shobande and Wosilat streets, but the police did not arrest them.

“The fight started on Thursday, but the police were able to chase the hoodlums away. On Friday night, they reinforced and started vandalising vehicles. We were hearing the sound of vehicles being smashed with cutlasses and hammers, and they also robbed people.

“Two vehicles belonging to my customers were vandalised. I will have to foot the bill of repairing the vehicles. The hoodlums even came back on Saturday, but we the residents had to defend ourselves and chased them away, because they had already done a lot of damage.”

A resident of the area, Yusuf Abubakar, said the hoodlums smashed the windscreens of over 200 vehicles during the invasion, adding that the Chairman, Itire-Ikate Local Council Development Area, Ahmed Apatira, had visited the community to assess the situation.

Abubakar stated, “The windscreens of vehicles that they destroyed were over 200. We were just hearing sound around midnight and residents, who peeped through their windows, estimated that the hoodlums were over 30 and were armed with cutlasses, torch lights and other weapons, with which they vandalised the vehicles.

“In the morning, we realised that a lot of vehicles had been destroyed on my street; it was later that we realised that vehicles parked on six other streets were also destroyed.

“When the Chairman of the LCDA and his entourage visited the area, they only observed what happened and left. A lot of residents have taken their vehicles away for repairs, while some are still parked at the spot where they were vandalised.”

Another resident, Bankole Ajirotutu, said up to 40 vehicles parked on Lagos Street were vandalised, adding that his car was among them.

The Chairman, Oredola CDA, Yinka Oniare, said the hoodlums covered their faces with masks when perpetrating the crime, adding that the business of mechanics in the area had been affected.

He stated, “The hoodlums were young boys armed with cutlasses, hammers and other weapons used in destroying over 200 vehicles parked on the roads. Most of the people, who saw them, said the hoodlums were masked. All the vehicles parked on Shobande, Ogunsami, Ogunmuyiwa, Oredola, Lagos, Oshiga and Salami Bashorun streets, including those belonging to customers of mechanics, were badly damaged.

“They also destroyed vehicles parked on Ogunsami Street and Salami Bashorun Street, where the Chairman, Apatira, lives.”

The state Police Public Relations Officer, Bala Elkana, however, said only 12 vehicles were vandalised, adding that gangs from a neighbouring community were responsible for the attack.

“It was not a clash; the gangs came from a neighbouring community that is having issues with gangs in the area. The gangs came through the lagoon around 4am and vandalised 12 vehicles parked on the streets and ran back. The police responded and arrested a suspect. Investigation is ongoing,” Elkana said.

The residents faulted the position of the police, saying they only visited one of the affected streets.

An official of the Lagos State Traffic Management Authority ignited the wrath of residents of Lagos after he seized the phone of a lady who tried recording an alleged illegal activity/extortion he was reportedly carrying out. 
 
Twitter user @MrMan who shared the video said the incident occurred at Alagomeji busstop and the traffic official allegedly ended up destroying the lady's phone. 
 
He tweeted;

A lesbian couple just had their dreams come true as Ellen DeGeneres has agreed to walk them down the aisle when they get married in a few hours.
 
Kate Austin took to Twitter to reveal she will be happy if Chrissy Teigen and Ellen DeGeneres walk her down the aisle as she marries her partner.
 
She disclosed that her parents have refused to attend and her dad also refused to walk her down the aisle because they don't approve of her lesbian relationship.
 
Sharing a photo from her and her fiancee's proposal, Kate wrote: "hi @chrissyteigen & @TheEllenShow!! my parents aren’t going to attend my wedding because they don’t like that i’m gay! i need someone to walk me down the aisle and someone else for a “father/daughter” dance. plz come, my fiancée and i would cry.  #shootingmyshot."

Mediapreneur Tunji Balogun popularly known as Teebillz , who is the estranged husband of afrobeat queen, Tiwa Savage has revealed that they are still legally married.

Teebillz made the revelation in a comment section after a blog shared a photo where Wizkid grabbed Tiwa’s ass on stage in Dubai.

The blog had shared a photo from One Africa Music Fest in Dubai with the caption “Tiwa Knocks Wizkid’s head for pressing her yansh while they were performing on stage in Dubai”

Reacting, a follower identified as @Nosatopnotch called out Teebillz saying “someone is molesting your babymama”

In his reaction, the music manager said “wife is different from babymama, if you have brain”

Last year, Tiwa was allegedly served divorce papers by her estranged Teebillz.

The Cable reported that Teebillz filed for divorce after efforts to resolve the problems in their marriage failed.

They learnt that Teebillz who had pulled a suicidal stunt in 2016, blaming the singer’s complete focus on her career, relocated to the United States for a fresh start.

He was said to have moved after working with life coach Lanre Olusola, a close source said.

The source explained that this was due to Tiwa’s insistence on focusing squarely on her music, leaving the demands of her home begging.

It was also learnt that Teebillz’s publicity stunt put a crack in their home which was never resolved.

The source was quoted to have said that, “Tiwa’s career was more important to her than TeeBillz’s wellbeing.

“He wants to move on and start life afresh,” the source added.

Davidson Iriekpen calls for the intervention of stakeholders in resolving the dispute between the Petroleum and Natural Gas Senior Staff Association of Nigeria, the Nigeria Union of Petroleum and Natural Gas Workers, General Electric and ARCO Group, over the non-payment of outstanding entitlements before it snowballs into a full blown crisis

All is currently not well between the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN), the Nigeria Union of Petroleum and Natural Gas Workers (NUPENG), General Electric International Operations Nigeria (GEION) and ARCO Group Plc, over the non-payment of entitlements to members of the unions. Last month, the two oil workers’ unions issued a 14-day ultimatum to industry stakeholders including the Minister of State for Petroleum, Nigerian National Petroleum Corporation (NNPC) and others to call GEION to order over the non-payment of terminal benefits and allowances to their members, who were laid off by Arco Group Plc in August 2016.

In a joint letter due to expire any moment from now, the unions threatened that failure to intervene in the dispute would leave them with no other option than go on a nationwide sympathy strike which would paralyse activities in the country.


In the letter addressed to the concerned officers and signed by the General Secretary of PENGASSAN, Lumumba Okugbawa, and General Secretary of NUPENG, Olawale Afolabi, they stated that it was obvious that the intervention of the Federal Ministry of Labour and Employment, which agreed that ARCO, Federal Inland Revenue Service (FIRS) and GEION should meet and reconcile the figures on the excess Withholding Tax (WHT) as alleged by ARCO was not going anywhere.

“The patience of our members is at the breaking point as they see their colleagues from ARCO wallowing in deprivation and hardship after toiling for several years due to deliberate ploy od some individuals and organisations to elope with the fruits of the labour.

“We, therefore, call on relevant authorities to compel GEION and any other concerned parties in this matter to do the needful for our members to get their final entitlements without further delay; failure of which the unions would be left with no other option but to go on sympathy industrial action nationwide for the entitlement of the workers to be paid,’’ the statement said.

Giving the genesis of the dispute PENGASSAN said ARCO provided services to GEION on Global Maintenance Services Contracts for the Nigerian Agip Oil Company (NAOC) Gas Turbines from 2006 to 2015. It added that ARCO’s payments for the services were routed through GEION, which had a corresponding duty under the Nigerian tax laws to deduct WHT from payments due to ARCO and remit same directly to the federal government through the FIRS.

It said the approved statutory deduction rate ought to be five per cent, but GEION applied a rate of 10 per cent to ARCO’s invoices. According to the oil workers’ union, ARCO protested this but GEION claimed that the statutory rate was 10 per cent and that the monies so deducted had been duly remitted to the FIRS.

“However, ARCO noticed that the value of the WHT credit notes issued by FIRS to ARCO, as evidence of receipts of the WHT deductions remitted by GEION did not match the amount that were deducted from their invoices. ARCO raised the issue again with GEION and both parties agreed that clarification should be sought from the FIRS on the appropriate and applicable WHT.

“The FIRS responded that the statutory rate is five per cent. GEION contested the position through their tax consultants, the PriceWaterHouseCoopers (PWC) and the FIRS reconfirmed its earlier position, adding that GEION remitted only five per cent and not 10 per cent as claimed by GEION.

The FIRS further directed GEION via a letter dated January 14, 2019 to remit the outstanding five per cent or provide evidence of payment within 10 days from the receipt of that letter. Unfortunately, GEION has refused to act further to pay what they unlawfully deducted and withheld from ARCO over the nine-year period.

“The association finds it criminal that in the face of overwhelming documentary evidence establishing Arco’s claim of alleged payment to the refunds demanded, GEION would still make unsubstantiated claim of alleged payments and remittances to the Federal Inland Revenue Service (FIRS), which are not backed by WHT credit notes, payments advices, receipts, bank statements or any other credible evidence,” it said.

Investigation by THISDAY revealed that the letter by the workers’ unions was not the first time attention would be drawn to the dispute between GEION and ARCO. It was gathered that between 2015 and 2017, the two companies were severally brought before the Federal Ministry of Labour and Employment over the issues of non-payment of accrued staff gratuity, redundancy benefits and overhaul allowances due to ARCO workers who were engaged on the NAOC OBOB contract.

Checks revealed that ARCO explained to the minister during those mediation meetings that it was unable to settle the outstanding obligations because GEION, who was the main contractor, had refused to pay it monies that were then due and outstanding, such as the balance of the demobilisation fee and the workers’ overhaul claims.
After several meetings brokered by the ministry, GEION and ARCO had reached an agreement for the closing out of the contract and payment of the fee subject to two very important issues which are the receipt by ARCO from GEION, of all outstanding WHT credit receipts due to ARCO for services rendered on the contract, and the resolution of the overhaul payment claim.

By law, WHT was to be deducted from ARCO invoices at the rate of five per cent of the value of each invoice. However, GEION had been deducting WHT at the rate of 10 per cent, in spite of ARCO protests. The attempt to resolve this issue gained traction when it wrote to demand a refund of overpayments it claimed it had made to the FIRS on certain ARCO invoices it deducted WHT from, at the rate of five per cent instead of 10 per cent.

The long-standing disagreement over what rate was applicable led to an agreement that the FIRS should be contacted for clarification. GEION stated that it would accept and abide by any clarification or ruling by the FIRS provided same was issued from the revenue service’s headquarters in Abuja.

ARCO wrote to FIRS to request the clarification and FIRS responded that the applicable WHT rate was five per cent and not 10 per cent. Upon receipt of the FIRS confirmation, ARCO wrote a letter dated November 6, 2017 to GEION requesting a refund of the excess deductions from its invoices arising from the wrongful application of 10 per cent withholding tax rate as against the statutory rate of five per cent.

Rather than refund the money as requested, GEION acting through its tax consultant, PriceWaterHouseCoopers, wrote another letter to the FIRS requesting a re-confirmation of the FIRS position conveyed vide the said FIRS letter dated November 2, 2017, and further asking how the excess withholding taxes deducted from the claimant should be treated, in the event that the FIRS maintained its position that the applicable WHT rate was five per cent.
By another letter dated July 26, 2018 the Executive Chairman of the FIRS had responded to GEION’s request and affirmed the statutory WHT rate deductible from the ARCO invoices as five per cent.

More importantly, the Executive Chairman of the FIRS directed GEION to make available to ARCO, all outstanding WHT credit notes issued in respect of all remittances of WHT made on ARCO’s behalf.
The implication of the FIRS clarification was that GEION had over the years been unduly deducting an additional five per cent over and beyond the statutory five per cent on ARCO invoices except for the few invoices mentioned in its letter.

In a recent letter to GEION, the Ministry of Labour and Employment had directed it to honour the agreement to ensure industrial harmony. The letter which was signed by the Permanent Secretary, Federal Ministry of Labour and Employment, William Alo, said its reconciliatory meeting with relevant parties on the dispute had earlier drawn up conclusions which all parties were advised to honour.

Alo, said following the dispute, the ministry on September 24, 2019, had brokered a conciliatory meeting with relevant parties, while also extending invitation to the FIRS.
The conclusions reached, according to documents seen by THISDAY, stated that GEION should apply to FIRS and request for the refund of the over-deducted sums paid to FIRS as agreed during the reconciliation meeting; that both GEION and ARCO should go back and within two weeks, reconcile the deductions.

It also showed that all tax deductions made by GEION on behalf of ARCO substantiated with documentary evidence, with the objective of remitting to FIRS, but which were not remitted to FIRS, should be refunded to ARCO within three days.

After the meeting with the ministry, rather than comply, GEION in a dated October 9, 2019 addressed to the Executive Chairman of the FIRS, had again asked the revenue service to review its records for details of the WHT remittances it made on behalf of ARCO from 2006 to 2008 in naira and dollars in order to enable it close the outstanding balances. It said it did not have information for the years, and was relying on the FIRS to provide it with the details of the taxes it remitted for the period.

“As earlier communicated, we do not have information for those years, and we are relying on the FIRS to provide us with the details of the taxes we remitted for the above period,” GEION said.
The FIRS on its part, wrote a letter to GEION dated October 17, 2019 wherein it requested it to respect agreement reached with the Federal Ministry of Labour and Employment.

The letter signed by Dick Irri read: “I draw your attention to your commitment at the held at the Federal Ministry of Labour and Employment wherein you agreed to make request for refund on behalf of ARCO Group. The agreements are clearly summmarsied in the letter by the ministry.

“You are therefore requested to immediately respect your commitment by requesting for refund on behalf of ARCO considering the fact that the time agreed has lapsed.”

But ARCO feels that GEION is using tricks to retain its monies which were illegally deducted, using FIRS as a cover. In letter dated November 7, 2019, addressed to the FIRS Chairman, it said the multinational has settled for a strategy of delay, deflect, conflate and confuse tactics in order not to pay the money it has been owing it.
It wondered why GEION would make a payment of N130,387 million to the FIRS in January 2019, when on September 18, 2019, it informed a meeting of PENGASSAN/NUPENG executives that all WHT payments had been made to FIRS and that it was the revenue service that was not doing its work effectively.

In resolving the dispute, observers believe that stakeholders in the oil and gas industry must ensure that GEION is made to do the needful not only in the interest of the sector but the long-suffering workers who need their entitlements for their betterment.

The two labour unions in the oil and gas sector, NUPENG and PENGASSAN, have petitioned the Minister of State for Petroleum Resources, Timipreye Sylva, the Group Managing Director of the Nigerian National Petroleum Corporation (NNPC), Mele Kyari and the Director General of the Department of State Services (DSS), Yusuf Magaji Bichi, over the non-payment of terminal benefits and allowances due to the lingering dispute between General Electric International Operation Nigeria (GEION) and ARCO Group Plc.

In a joint letter addressed to the concerned officers and signed by the General Secretary of PENGASSAN, Lumumba Okugbawa, and General Secretary of NUPENG, Olawale Afolabi, the two unions called for the intervention of the minister, NNPC and DSS before the matter snowballs into an industrial crisis.
They added that ARCO said its inability to fulfill its obligations to the workers was because of the excess withholding tax deduction made from Arco by GEION.

The unions noted that during the intervention of the Federal Ministry of Labour and Employment, it was agreed that ARCO, Federal Inland Revenue Service (FIRS) and GEION should meet and reconcile the figures on the excess withholding tax as alleged by ARCO.

They added that GEION and ARCO should conclude the reconciliation in two weeks so the workers could be paid.
The agreement also stated that the sum confirmed by the Lagos State Inland Revenue Service (LIRS) office as having been remitted by GEION, but which is under dispute should be reconciled between GEION and FIRS within two weeks to pave way for further action.

The unions, however, said GEION had not taken the specific steps agreed at the meeting to facilitate the process for ARCO to pay the workers their final entitlements.
They threatened that failure to intervene would leave their members with no other option than go on a nationwide sympathy strike which would paralyse activities in the country.
