UNILAG governing council sacks Vice Chancellor, Professor Toyin Ogundipe

The Vice-Chancellor of the University of Lagos (UNILAG), Professor Olawatoyin Ogundipe, has been sacked by the governing council of the institution.
 
Ogundipe's removal was announced during the meeting of the Governing Council of the institution which held at the National Universities Commission (NUC) building in Abuja on Wednesday August 12.
 
Seven members of the council voted for the removal of Ogundipe as Vice-Chancellor while four others voted against the motion for his sack.  One of the members voted that he should rather be placed on suspension. 


The meeting was presided over by its Pro-Chancellor and Chairman of Council, Dr. Wale Babalakin (SAN). He is expected to announce a new Vice-Chancellor of the University by 5pm today.
 
A statement released by the council states that Ogundipe was removed for acts of wrongdoing, gross misconduct, financial recklessness and abuse of office.

Ogundipe, FAS from office as Vice Chancellor of the University with immediate effect.


“The decision was based on the Council’s investigation of serious acts of wrongdoing, gross misconduct, financial recklessness, and abuse of office against Professor Oluwatoyin T. Ogundipe.”the statement read

However, members of the University's Senate have vowed to resist the move to unseat Ogundipe. A representative of the school's Senate who was at the council meeting, Prof. Bola Oboh sent a message to other members of the senate. It reads:

Babawale Babalakin, the Pro-Chancellor waited for the tenure of Prof. Chukwu and Prof. Familoni to end, to call an Emergency Council meeting.


Based on the Dagari report, without allowing the VC defend himself, the Pro-Chancellor called for a vote for the removal of the VC.


I (Prof. Oboh), Prof. Odukoya, Prof. Leshi and John Momoh voted against the removal of the VC. Six persons (excluding Babalakin) voted for.

Babalakin then went ahead to announce the removal of the VC.


Dear Senate members, the procedure for removal of persons in office is clear and this was pointed out to Babalakin several times but he turned deaf ears.


He said he will announce the Ag. Vice Chancellor at 5pm. I have excused myself that I need to report to Senate members the shameful act currently ongoing. Please let us arise to fight this.”

Meanwhile, in a release signed by the Vice Chancellor himself, he insisted he remains the Vice Chancellor and advised that the release by the Registrar be disregarded

Ogundipe, FAS has been removed from office with immediate effect.

This is untrue and a figment of his imagination. Therefore, stakeholders of Unilag and the general public are advised to disregard this mischievous disinformation about the sitting Vice Chancellor of Unilag, contained in that notice. Professor Ogundipe still remains Unilag’s Vice Chancellor.

The recently sacked UNILAG VC, Professor Oluwatoyin Ogundipe is presently on the premises of the University Campus, leading the protest by the ASUU, even as the University Senate rejects his sacking.

Rising from its emergency meeting held on Thursday morning, by 88 members and anchored by Prof Chioma Ago, a former Dean of the Faculty of Law, the institution’s Senate said the removal of Ogundipe was against UNILAG’s regulation, adding that the Council removed Ogundipe without giving him the opportunity to defend himself.

They also kicked against the appointment of Prof Omololu Soyombo as Acting Vice Chancellor of the institution.

“Part of the condition for the removal of a Vice Chancellor is that a joint committee of the Senate and Governing Council must sit and investigate with three representatives from each side but the Senate was never represented, the Senate was never consulted, the Senate never knew the allegations against their member.

“The removal of Prof Ogundipe did not follow the Act establishing the university. He was not given fair hearing and the opportunity to defend himself.

“The Senate therefore rejects the removal of Prof Ogundipe and the appointment of an Acting VC."

They said vice-chancellor of UNILAG and any other university in a sane society could not just be removed from office the way the governing council of the university did to Professor Ogundipe at its emergency meeting in Abuja on Wednesday and therefore the action was not only illegal and condemned in its entirety, but would not also stand.

They said they were all passed a vote of absolute confidence on Professor Ogundipe’s leadership style while on the other hand, totally lost confidence on the current governing council of the university.

They made this known shortly after their separate and also joint meetings on campus, on Thursday, even as the embattled vice-chancellor, Prof Ogundipe, also surfaced on campus later.

Speaking to journalists at the end of the senate meeting, Professor Chioma Agomoh, who is a former dean of the Faculty of Law of the university, said “the senate without exemption has unanimously agreed that due process was not followed concerning the purported removal of Prof Ogundipe and therefore would not accept his replacement.

According to her, there are laid down rules and regulations as well as procedures to follow to remove a vice-chancellor if the situation arises and these were not followed in this case and therefore the senate has resolved not to recognise any surrogate that the governing council wants to impose on the university as a vice-chancellor.

“Things must be done properly. Nobody can’t just sideline the joint committee of the senate and council in a matter like this and that is why the Senate will not fold its hands and watch the system to collapse not only because of now but for the generations yet unborn,” she stressed.

On their parts, the Joint Staff Union (JSU) comprising the Academic Staff Union of Universities (ASUU), Non-Academic Staff Union (NASU), Senior Staff Association of Nigeria Universities (SSANU), and the National Association of Academic Technologists (NAAT) in both the main campus and at the university’s college of medicine, Idi- Araba said even though they had no problem with the leadership style of Prof Ogundipe, their major concern was about the institution he represented.

All the leaders of the four unions, including Dr Dele Ashiru (ASUU), Mr Olusola Sowunmi (SSANU), Mr Ajibade Kehinde (NASU), Sulyman Lawal(NAAT), as well as Mr Tunde Aderibigbe(NASU CMUL, Idi-Araba), and Mr Ayo Alli (SSANU CMUL), were on ground to address the journalists at the end of their congress.

They said they were not against probing him as an individual nor any other person in the university if there is a situation that warrants such, but due process must be followed.

According to them, their argument was on the premise that Ogundipe was not notified of the allegations levelled against him nor a panel constituted to investigate him let alone given a fair hearing.

“So, to all of us, Ogundipe’s purported removal is not only illegal and unjust but it is also vindictive and tantamount to jungle justice, and it would not stand,” they added.

“And that is why we are calling on the President Muhammadu Buhari who is the visitor to the university to prevail on the chairman of the governing council, Dr Wale Babalakin on the matter,” the said.

They said Babalakin only wanted to show to the whole world that he could do and undo without anybody queries his action.

In his short remark, the embattled vice-chancellor insisted that nobody could unjustly remove him from his seat as the vice-chancellor.

He said he had never been questioned let alone indicted of any wrongdoing let alone financial impropriety in the university where he rose across ranks to become the vice-chancellor nor elsewhere.

Professor Theophilus Omotunde Soyombo, who was appointed the Acting Vice-Chancellor of the University of Lagos, UNILAG, on Wednesday by the Governing Council of the university, has said he has resumed duties.

Speaking in a telephone conversation, the Professor of Sociology, said he resumed office because the letter of appointment given him by the Council notified him to do so with immediate effect.

Though he would not say whether he has physically resumed at the 11th Floor, Senate Building office of the VC, he said he would communicate the public later on the situation.

However, Saturday Vanguard gathered that other things being equal, Soyombo would be in the Senate Building on Monday.

However, the Chairman of the Council, Dr Wale Babalakin, SAN, while briefing newsmen at the Ikeja Airport in Lagos, accused Professor Oluwatoyin Ogundipe of exceeding his approval powers on a number of occasions.

The, therefore, called on the necessary agencies of government to investigate Ogundipe.

“The financial guidelines of the University of Lagos give the Vice-Chancellor the power to spend not more than N2.5 million in some instances without the approval of the Governing Council and anything higher must be brought to the Council for approval. “However, Ogundipe spent N49 million to renovate his official quarters without anybody approving that.

“He also approved N41 million for the Bursar to renovate his official quarters too. That is unacceptable. He must be investigated. We need to do that for us to start building the university. I can tell you that when we probed the account of the university, it was in tatters,” he said.

On the claim that due process was not followed in the removal of Ogundipe as VC, Babalakin said “as a product of law, I don’t engage in things that will trample the law. Due process was followed. When the Council set up a committee to look into the finances of the university since we came on board, the report indicated a number of people including Ogundipe.

‘He wrote a reply and even spoke for over one hour defending himself. The law of the university is clear on how some officers can be removed from office. During Wednesday’s meeting, the issue was put to vote and we can do open ballot or secret ballot as we used to do on contentious issues.

“The people not only voted, but they added their comments. I also not only read out the votes, but the comments put in by everyone. I can tell you that nobody faulted what was read out as not what they wrote.”

On the stance of staff unions in the university rejecting the appointment of an acting VC, Babalakin stated that only a few vocal people benefiting from the current dispensation were doing that.

” If you go to the campus now and do a secret ballot of how popular Ogundipe administration is, you would see that it is unpopular. What was going on was misappropriation and looting of the scarce resources of the school,” he noted.

On whether the supervising Federal Ministry of Education was in support of the action taken, Babalakin explained that he had not heard anything condemning or faulting the action from the ministry.

Recall that on Wednesday the Governing Council at its meeting in Abuja removed Ogundipe as the VC of the UNILAG.

In his stead, Soyombo was appointed as the Acting Vice-Chancellor.

The development was a culmination of the faceoff between Ogundipe and Babalakin on the running of the university and about certain decisions being taken.

Ogundipe has since gone to court to challenge the action.

Wale Babalakin, pro-chancellor of the University of Lagos, has said that due process was followed in the removal of the former Vice-Chancellor of the University, Professor Oluwatoyin Ogundipe and that anyone who is against it must have been benefitting from the alleged acts of corruption' perpetrated during Ogundipe's administration.
 
Professor Ogundipe who was appointed as the Vice-Chancellor of the University in November 2017, was removed from office at a meeting of the governing council of the university, held at the National Universities Commission (NUC) in Abuja, on Wednesday, August 12.
 
Ogundipe and some members of staff of the University have faulted the process of his removal. saying due process wasn't followed. Ogundipe has since gone to court to challenge his removal.
 
However, speaking to newsmen at the Murtala Muhammed Airport, Ikeja, on Friday, August 14, Babalakin said the “focal minority” opposed to Ogundipe’s removal benefitted from the alleged corruption under him.

Quote:“The confusion is that most people don’t how governing council operates. There was full compliance of the law in the removal of Prof Ogundipe.


The issue has been lingering on for a long time. Series of attempt were made to reconcile but the VC was not forthcoming… a focal minority, who are benefiting from the corruption in UNILAG which has become cultural.


Due process was followed in the removal of Ogundipe. After the council committee indicted the VC, he wrote his defence in May and spoke for one hour. His sack was done in accordance with UNILAG law.


The votes were counted with each council members’ comments. Everyone voted, they didn’t just vote but they made comments and I read out all the comments.


Go and read the law, what the law said is that when a Vice Chancellor is removed and you have a complaint, you will write an appeal to the visitor. He cannot on his own, declare that he has not been removed as Ogundipe has done.


He cannot on his own confront his employers. In law, he has resigned because if you challenge your employer and you are still in his employment, you have actually left.


“The weakness of Ogundipe is that his legal advisers have not done a very thorough job. There is no stalemate and there is no chaos in the university because the law would take its course. It is not in the place of the removed VC to say he has not been removed. He cannot be a judge in his own court.


“He cannot on his own declare that he has not been removed. He cannot on his own decide to confront his employer.”
 
Babalakin accused Ogundipe of looting the treasury of the institution during his administration as Vice-Chancellor.
 
Quote:“Professor Ogundipe has been looting the university and looting it recklessly, that’s the plain truth that we should not hide. There is misappropriation and there is direct looting of the university. All attempts were made to put an end to this.


The former VC spent N49 million renovating his house. Under the process, this has to be done with approval from the council, he sought no approval. To cover-up, he gave the bursar N41 million to renovate his official residence. The official residence of the bursar can be built for N41 million from scratch, this was what was spent on renovation.”
