D’banj, has demanded N100m from Miss Seyitan Babatayo who accused him of raping her in a hotel room on December 30, 2018In a pre-litigation letter signed by his lawyer, Chief Mike Ozekhome (SAN), the musician asked his accuser to make a payment of N100m within 48 hours or face legal action.

Woman who accused D'banj of rape released after being arrested







Seyitan Babatayo, the lady who accused D'banj of raping her in 2018 has been released after being arrested by the Lagos state police. 
 
Babatayo's lawyers confirmed her arrest on Tuesday June 16. Her lawyers told Premium Times; 
 

“They arrested Seyitan this morning in Lagos. They arrested our client but somebody is already there to facilitate her release on bail.
“This matter is coming to Abuja by tomorrow; we are petitioning. The Financial Crimes Investigation Division (FCID) is taking up the petition tomorrow. That is all I can say about it for now."

 
In a notice D'banj's lawyers Mike Ozekhome Chambers served Ms Babatayo, she was asked to pay the singer N100m within 48 hours as compensation for falsely accusing him of rape or risk legal action.
 
D'banj also demanded for a letter of apology and retraction of her statements which should be published in four national dailies.
 
The notice partly read; 
 

“We have been instructed to demand and we do hereby demand from you the following: That your client makes an outright apology and a total retraction of each and every false allegation made against and concerning our client.

“The said apology and retraction shall be published in four national dailies with wide circulation in Nigeria as well as on social media platforms and handles being used by your client and her hirelings.

“That your client makes a compensatory deposit of the sum of N100m only through this chambers in favour of our client to assuage his battered image."

I'm done and leaving everything behind - Lady who accused D'banj of rape says as she denies being arrested







Seyitan Babatayo, the lady who accused D'banj of rape has denied claims of getting arrested alongside her mother. 
 
Report of Ms Babatayo's arrest which investigative journalist Kiki Mordi insisted happened, had been trailed by mixed reaction as some social media users affirmed that D'banj is trying to clear his name while others condemned and accused him of intimidation. 
 
In a tweet she shared after her alleged arrest gained public attention yesterday June 17, the lady stated that she is moving on and leaving everything behind her. 
 
She tweeted;

No matter how long a lie lasts, the truth will always prevail - Don Jazzy reacts to rape allegation against D'banj







Don Jazzy has weighed in on the rape allegation against his former business partner D'banj, which has taken a prominent spot on social media. 

 
In tweets he shared, the ace music producer implored the police to thoroughly investigate and the court to do justice on the case which he said saddens his soul. 

 
Don Jazzy who urged all victims to speak up, affirmed that it is also important that every accused person is given an opportunity to set the facts straight.
 
The Mavin CEO who averred that the truth will always prevail no matter how long a lie lasts, pointed out that the fact remains that one of them is a victim and the law will protect that person.
 
He tweeted;

Rape: IG Orders Probe Of D’banj 

The Inspector-General of Police, Mohammed Adamu, has ordered a probe into the allegations of rape levelled against Music Icon, Oladapo Oyebanjo aka D’Banj.

This is contained in a letter with reference number CB.7000/IGP.SEC/ABJ/VOl.484/801 signed by the Principal Staff Officer to the IG, DCP Idowu Owohunwa.

The letter was addressed to the Deputy Inspector-General of Police, Force Criminal Investigation Department, Area 10, Garki, Abuja.

The IG’s letter was in response to a petition written to the IG by Mr. Tommy Ojoge-Daniel, a lawyer to Miss Seyitan Babatayo, who accused D’Banj of raping her in 2018.

The letter written by the IG is titled, ‘Re: Petition Against (1) Oladapo Daniel Oyebanjo (Aka D’Banj) for Rape Indecent Sexual Assault, Attempted Assault on Miss Seyitan Temidayo

The letter read in part, “I forward herewith copy of letter dated June 5, 2020 received from Ojoge, Omileye and Partners on the above underlined subject. I am to respectfully convey the directive of the Inspector-General of Police that you treat.

“Accept the assurances of my esteemed regards please.”

Seyitan’s friend, Benjamin Ese, in a Twitter thread in early June had told the story of how D’Banj allegedly raped Seyitan at a hotel two years ago – in December 2018.

She said it happened at an all-white party where D’Banj allegedly offered her friend some money to spend the night which she rejected until he surprisingly showed up in Seyitan’s hotel room around 2 in the midnight.

“D’Banj drove all the way from Eko hotel where he was lodged and came down to glee hotel in Victoria Island at midnight 2.40 am and collected the spare key from the receptionist,” Ese said in the thread which has since sparked an outrage.

She said D’Banj allegedly “got into my friend’s room and forcefully threatened he would walk her out of the room naked, kept his fingers in her vagina and repeatedly raped her.”

The rape experience, Ese said had caused Seyitan some trauma since the incident happened.

One month after Ese’s tweets, Seyitan came out publicly to present herself as the lady who was allegedly raped by D’Banj in December 2018.

The musician, however, denied the allegations levelled against him and asked his accuser to make a public apology and also pay him the sum of N100m in damages.

On Tuesday, however, some policemen allegedly acting on the instruction of the Oliver Twist crooner detained Seyitan for over 24 hours and intimidated her, making her delete all chats, social media posts and other vital information from her phone.

The incident has sparked an outrage on social media with D’Banj trending on social media for the last two days

D’Banj is one of Nigeria’s biggest artists having won several music awards, including the awards for Best African Act at the MTV Europe Music Awards 2007, Artist of the Year at the MTV Africa Music Awards 2009, Best International Act: Africa at the 2011 BET Awards, and Best-selling African Artist at the 2014 World Music Awards and the Evolution award at the 2015 MTV Africa Music awards.

Feminists and several rights groups have called on the police to ensure that justice is served regardless of the musician’s status.

Police interrogate D'banj over rape allegation







Nigerian singer, Oladapo Daniel Oyebanjo, popularly known as D'banj, has been interrogated by the Nigeria Police Force over the rape allegation made by Seyitan Babatayo.
 
The singer was interrogated by an Assistant Commissioner of Police, Adaku Anya, at the Force Criminal Investigation Department, Garki, Abuja, Punch reports.
 
The publication adds that Seyitan was also invited for questioning but pleaded that she couldn't afford to travel to Abuja so she was allowed to report at the Force Criminal Investigation Department (FCID) in Alagbon, Ikoyi.
 
According to the publication, a top police source said D'banj insisted in his statement that he never raped his accuser, Seyitan Babatayo.
 
The source said: "D’Banj has been questioned twice at the FCID, Abuja. He was questioned last week and also this week. We will leave no stone unturned as we investigate the matter."
 
"Seyitan appealed with us that she had no means of travelling down to Abuja. So, she has been given the option of reporting at the FCID Annex, Alagbon, Ikoyi," the officer added.
 
Recall that the Inspector-General of Police, Mohammed Adamu, had ordered a probe into the rape allegation against the singer (read here). The IG had referred the case to a Deputy Inspector-General of Police to handle.

IGP orders probe of policemen who arrested D’Banj’s rape accuser, Seyitan Babatayo







The Inspector-General of Police, Mohammed Adamu, has ordered the probe of the policemen who allegedly arrested D'banj's rape accuser, Seyitan Babatayo.
 
The IGP gave the order in a letter signed on his behalf by his Principal Staff Officer, DCP Idowu Owohunwa and addressed to the Deputy Inspector-General of Police, Force Criminal Investigation Department, Garki.
 
The IGP's letter was sequel to a petition written by Seyitan’s lawyer, Ojoge, Omileye and Partners.
 
In the IGP's letter titled  "Re: Petition Against Inspector Abraham, Supol Ugowe and the Entire Police Officers Team at Ikeja, Lagos Division of the Inspector General of Police", the IGP asked that the petition from Seyitan Babatayo's lawyer be addressed.
 
The petition from Babatayo's legal representative - Ojoge, Omileye and Partners -  allege that policemen attached to the Intelligence Response Team arrested Seyitan on the directive of D’Banj and detained her for over 24 hours.
 
It was also alleged that they denied her access to her phone and her lawyers and she was subjected to intimidation and psychological torture by the policemen.
 
The petition read in part, “On Tuesday, June 16, 2020, our client was picked up alongside a friend, Favour, at her residence in Lagos by the officers of the Ikeja IGP IRT. The arrest was without any warrant and neither our client nor her friend, Favour, was informed of the reasons for their arrest.
 
“According to our client, she was told to write a statement denying ever meeting with Mr. Oyebanjo (D’Banj) and to also state that she lied against the person of Mr. Oyebanjo. In actual fact, our client was about to write the statement which she believed would be a basis for her release when the counsel came in and stopped her from writing such a statement.
 
"The counsel further informed the policemen that all actions to the alleged rape of our client in December 2018 by Mr. Oyebanjo have been transferred to the DIG FCID for a thorough investigation and that they need to stay the action.”
 
The petition adds that the counsel told the policemen to release his client and he would bring her back to the station when she's needed but the policemen said Seyitan had not yet spent 24 hours in custody.
 
The counsel returned the following day and alleged that D’Banj’s Manager, Damien Okoroafor, was present at the police office.
 
He said that the process of bailing Seyitan had started before D'banj's manager, Okoroafor’s began ordering officers around. Because of this, the officers refused to release Seyitan and threatened to approach a magistrate court to obtain a remand order to detain Seyitan for two weeks.
 
He said Seyitan was forced to delete all social media posts she had made about D’Banj and was also forced to make a public statement absolving D’Banj of rape which she did to gain her freedom.

Nigerian police denies detaining Seyitan after she accused D'banj of rape









The Nigerian police has denied detaining Seyitan Babatayo, the lady who accused singer, D'banj, of rape. 

 

A police source who spoke to Vanguard, said D’banj reported on three separate occasions at FCID for interrogation and statement, while Seyitan repeatedly refused to show up. Her alleged non-appearance led to the prompt dispatch of officers by the Force CID to Lagos, to invite her for written statement and interrogation on the alleged rape incident. 

 

The police source insisted that there might be a mix up by the legal representative of Seyitan over claims of being arrested and detained by Police operatives at Ikeja in Lagos for 24 hours.

 

The security official insisted that the alleged rape victim was only invited to give her written statement and also to be interrogated as it was necessary for her to come forward to give a statement to back up her accusation.

Mike Ozekhome Sues Seyitan For N1.5B For Accusing D'banj Of Rape 

Dbanj procured the services of controversial and foremost Senior Advocate of Nigeria, Mike Ozekhome (SAN), to slam a libel suit of N1.5 billion naira on the Ms. Seyitan, a lady who had accused him of rape.

The accuser, Ms. Seyitan, had alleged that Dbanj raped her on December 31, 2018, at Glee Hotel in Victoria Island, Lagos.

She revealed that the popular musician after acquainting with her at a party earlier where she had turned down his advances for intimacy –

– had driven all the way from Eko hotel where he was staying and came down to Glee hotel in Victoria Island at midnight 2.40 am

– collected her room’s spare key from the receptionist and forcefully gained access into her room threatening to walk her out of the room naked if she refused him even as he kept his fingers in her vagina and repeatedly raped her.

Hence, On Thursday, 18, 2020, events took a turn as varying reports emerged of D’banj’s arrest of Seyitan.

Information gathered revealed that some policemen allegedly acting on the instruction of the singer, reportedly detained Seyitan for over 24 hours

– and made her delete all chats, social media posts, and other vital information related to the matter from her phone.

However, The incident elicited a wide range of criticism on social media with Nigerians calling out D’banj for intimidation and abuse of power.

Rape allegation: DBanj challenges activist Segalink to ''say the truth''







DBanj has taken to his Twitter handle to challenge activist, Segun Awosanya aka Segalink to say the truth concerning the controversies surrounding the rape allegation leveled against him by a lady, Seyitan Babatayo. 
 
Recall that on Friday, July 3, Segalink took to Twitter to condemn the ''vicious and hateful approach of BMC & e-Feminists'' on the case which he said is at the expense of Seyitan’s wellbeing. He alleged that the "malicious interest group" erroneously believe that Seyitan’s reluctance in taking their orders, was connected to him. Read here.

Police clear D’Banj as Seyitan withdraws rape petition







Oladapo Oyebanjo, aka D’Banj, has been cleared of rape after his accuser, Seyitan Babatayo, withdrew her petition.
 
In a letter dated July 17, 2020, addressed to the Inspector-General of Police through her lawyer, Seyitan said she was withdrawing from the case for personal reasons.
 
The letter read in part, "We hereby officially notify you of our client’s intention to withdraw and discontinue her petition against Mr. Oladapo Daniel Oyebanjo aka D’Banj for personal reasons. Our client further humbly applies that the investigation and all other action that is currently being carried out by the police with respect to the statement."
 
Reacting to the letter, the Deputy Commissioner of Police (Admin), Umar Sanda, said investigation had discontinued due to lack of evidence.
 
Human rights group, Stand To End Rape Initiative  (STER), said Seyitan decided to end the case without receiving any monetary compensation.
 
The statement from STER reads in pert: "On July 13, 2020, Ms. Babatayo informed STER that a private non-monetary agreement was reached with D’Banj’s team. We, therefore, present this statement as the full account of our stewardship on this matter."
 
 

 
Recall that Seyitan had accused D'banj of raping her at Glee Hotel, Victoria Island, Lagos, in December 2018. She came out after a model scout called out D'banj for raping a female friend of his (Seyitan), though he didn't name her. Also, D'banj's former manager said that Seyitan had called him one morning in December 2018 to say that D'banj got the key to her hotel room and raped her.
 
Seyitan, through her lawyers, filed a suit, demanding an apology from the singer.
 
D'banj denied the allegation and sued Seyitan for defamation. He demanded N100 million Naira as compensation
 
Later, D'banj was accused of using his influence to intimidate and detain Seyitan after she couldn't be reached by her family/ lawyers. While she couldn't be reached, a tweet was sent out via her Twitter account to promote D'banj's new song. Another tweet was also sent out stating that she wanted to leave everything behind her and move on.
 
Seyitan later released a statement where she claimed that she was detained and intimidated by D'banj's people and they took control of her social media account. She also said she stands by her claim that she was raped by the musician (read here). D'banj reacted by suing her again, this time for N1.5 billion (read here).
 
She has now withdrawn the petition and the police are discontinuing the case against the musician.

"I want my peace," Seyitan Babatayo says as she releases statement after dismissing her petition against D'banj







Seyitan Babatayo has released a statement after it was revealed that she has dismissed her petition against singer D'banj after accusing him of rape.
 
Her statement is a reaction to a statement released by the human rights group, Stand To End Rape Initiative  (STER), that has been trying to get justice for her.
 
In a statement released after Seyitan dismissed her petition, STER accused activist Segun Awosanya, aka Segalink of attempting to "pervert justice" in the case between Seyitan Babatayo and D’banj (read here).
 
STER claimed in the statement that Segalink texted an address to Seyitan and asked her to attend a meeting with D’banj there. STER said the meeting was aimed at negotiating a private settlement and Seyitan's legal counsel was also scheduled to be in attendance.
 
The NGO said that they were also invited to the meeting but declined because "out-of-court settlements go against STER’s policy."
 
STER said that "such settlements, in our experience, often involve an asymmetry of power between the accused and victim."
 
They added in the statement: "More importantly, while private settlements are usual in civil disputes, they are, however, not applicable to criminal cases, particularly where a felony has been alleged to have been committed, only the State has the authority to discontinue a criminal investigation and prosecution.
 
"An attempt by any private individual(s) to circumvent the authority of the State in criminal investigations may amount to a conspiracy and attempt to pervert justice."
 
Segalink reacted, stating that Seyitan and her family were not interested in pursuing the case or a legal battle.
 
Segalink said: "Seyi and her family are not interested in any CASE or legal battle… before the involvement of STER or police."
 
Reacting to STER's statement, Seyitan cleared Segalink of trying to pervert justice. She said it was her family that tried to reach a settlement so they reached out to Segalink.
 
She wrote: "It was my family members and I that did resolve to and subsequently contacted @Segalink to facilitate a meeting with D-banj's team for a resolution of the issue and as I did not intend to continue with this contention."
 
She made other points in her statement and ended with: "I really want my PEACE. Thank you."
