Supreme Court Sacks David Lyon, Orders Diri Duoye To Be Sworn In

Barely 24 hours to his inuaguration the Supreme Court has sacked Mr David Lyon as Governor Elect of Bayelsa State.

A five man panel of the apex court presided by Justice Mary Peter-Odili nullified the election of Lyon on the grounds that his deputy, Senator biobarakuma Degi-Eremienyo presented false information to INEC in aid of his qualification for the November 16 governorship election in Bayelsa State.

The apex court in the judgment delivered by Justice Ejembi Eko consequently ordered the Independent National Electoral Commission INEC to withdraw the certificate of Return issued to Lyon and Degi-Eremienyo.

Justice Eko also ordered that INEC immediately declare the party with the highest number of lawful votes and geographical spread.

With the judgment of the apex court, candidate of the PDP, Diri Duoye will now be inuagurated as governor of Bayelsa State.

Former lawmaker representing Bayelsa East Senatorial dictrict in the red chamber, Ben Murray-Bruce has congratulated Senator Duoye Diri over his supreme court victory today February 13. 
 
Recall LIB reported earlier that a five-man panel of the apex court led by Justice Mary Peter-Odili, annuled the election on grounds that the deputy governor-elect Degi-Eremieoyo ran for the election with forged certificates.
 
The court ordered the Independent National Electoral Commission to withdraw the certificate of Return issued to the All Progressives Congress’ candidates as the winners of the November 16th 2019 governorship election in the state and issue fresh certificates to the candidates of the PDP, Douye Diri who reportedly scored the next highest number of votes during the election.
 
Congratulating Senator Diri over the Supreme Court judgement, Ben Murray-Bruce stated that it is a "victory for truth and most especially, a victory for the great people of Bayelsa State."
 
He tweeted;

Earlier today, the Supreme Court sacked the governor-elect of Bayelsa State, David Lyon, of APC and his Deputy, Biobarakuma Degi-Eremieoyo, and declared Douye Diri of PDP as the winner of 2019 state governorship election. After the news broke, Davido took to Twitter to hilariously react to the Supreme Court's verdict in a series of tweets. 
 
In one tweet, the singer revealed he was at a club in New York when the Supreme Court upheld Governor Gboyega Oyetola's victory in the 2018 Osun governorship election, despite a tribunal ruling declaring his uncle, Ademola Adeleke, the winner of the election in March 2018. 
 
He wrote: 'I Dey club for New York when Supreme Court give us our own last year !! Casanova just Dey look me say wat happened ? Why u not turning up no more I say Baba wait first my chest. '
 
In another tweet, the singer added: 'So wait? It’s not even about winning again.. u can actually win get sworn in all and then vamoos ! Chai'

No one will be sworn-in tomorrow in Bayelsa - Oshiomhole rejects Supreme Court judgement which sacked David Lyon

The National Chairman of the All Progressives Congress (APC), Adams Oshiomhole has reacted to the Supreme Court which sacked his party's candidate David Lyon as the winner of Bayelsa governorship election. 
 
In a statement made available to newsmen, the APC Chairman pointed out that the People's Democratic Party candidate, Senator Duoye Diri who the Supreme Court directed the Independent and National Eelctoral Commission (INEC) to give a new certificate of return to, does not have one quarter of the total lawful votes which was cast in two third of the eight local government areas of Bayelsa state. 
 
According to Oshiomhole, no one can be sworn in as Governor of Bayelsa State legally tomorrow February 12, because the annulment of David Lyon's victory means there is no candidate that meets the requirements of the law and that will amount to deliberate abuse of legal process.
 
He said; 
 
Quote:“From the online reports we have read, the Supreme Court ruled that the certificate of return earlier issued to David Lyon be withdrawn and directed INEC to issue a certificate of return to the person who scored the highest votes after Lyon if such a person has the required spread.

“As a political party, we respect the rule and we respect and have confidence in the judiciary. However, this judgement lacks the fruits of justice. For me and our party, at the heart of election is the issue of who did the people actually voted for?
“Is there a case of impersonation on the part of the deputy governor elect? Is there any other person who has come out to claim that name as to raise doubt as to whether this is the deputy governor elect dually elected along with the governor during the Bayelsa governorship election.

“Where justice and democracy thrive on the alter of technicalities, it constitute danger to our democracy. Nobody has raised issues whether David Lyon and his running mates won over whelming majority.

“Issues of whether a chieftaincy title is part of a name or not could not be a reason to dismiss the wishes of the great people of Bayelsa state who reposed absolute confidence in the election of David Lyon and his running mate during the last governorship election.

“It is not a state secret. If as the Supreme Court has ruled, David Lyon cannot be sworn in as governor and that the person who has the highest number of vote and spread be sworn in, it simply means that from tomorrow, there will be no government in Bayelsa state.

“As far as we know, the next candidate who happen to be a PDP candidate does not have one quarter of the total lawful votes cast in that election in two third of the eight local government areas in Bayelsa state.

“Therefore, from the facts available to us and in consultations with our lawyer, it is clear that there no candidate that meets the requirements of the law which means that no one can be sworn in tomorrow legally unless there is deliberate abuse of the legal process.

“We have accordingly asked our lawyers to look at all the windows that exist in law and take steps to ensure that the will of the people of Bayelsa state is not undermined on the whims of technicalities.”
 
The former Edo State Governor recalled how the Supreme Court ordered a fresh election after nullifying the election of former Governor of Bauchi state, Adamu Muazu in 1999. 
 
He added; 
 
Quote:“When judges make judgements, they are published and there are those ones that laymen can understand. In 1999, there was a similar case in Bauchi involving Governor Adamu Muazu.

“The court found that his running mate was not qualified to contest the election and the Supreme Court nullified the election of Adamu Muazu and directed INEC to conduct a fresh election.

“I believe it is the same Supreme Court and therefore, we have asked our lawyers to explore all legal windows to ensure that Bayelsa people are not denied their wishes.

“Let me say that bad as the case of Zamfara was where after we have won the elections, the court held that APC did not conduct primaries and therefore did not participate in that election. This one is totally different because proper election was conducted.

“This is not another Zamfara case. The essential ingredients are different and so, the outcome and consequences cannot be the same. We want to assure our members across and Nigerians that we are a law abiding party, we still believe that the will of Bayelsa people will prevail.”

Degi-Eremienyo: The Conflicting Names That Disqualified APC Deputy Governor


These are the different names traceable to the APC Deputy Governor in Bayelsa that led to Supreme Court disqualification of the governor.
He bore these names at different stages of his life.

Mr Degi-Eremienyo’s name was written as Degi Biobara in his primary school certificate.
The documents from his secondary education bore Adegi Biobarakumo, as his name.
While that of his university education had Degi Biobarakuma as his name.

Also his MBA certificate had Degi Biobarakuma Wangaha as the name of the same person.
As the Deputy Governor-Elect he bore
Mr Degi-Eremienyo.

The Supreme Court on Thursday sacked David Lyon and Sen. Biobarakuma Degi-Eremienyo, as the governor and deputy elect in the Nov. 16, 2019 Bayelsa governorship election.

Justice Ejembi Eko, who delivered the lead judgment reinstated the Nov. 12, 2019, Judgment of the Federal High Court in Abuja that disqualified Degi-Eremieoyo from participating in the governorship poll.

The court held that the trial court was right in finding the deputy guilty of presenting false information to INEC.

The Justice Mary Odili-led panel, held that no person shall be qualified to contest election if he presented false information for the purpose of election.

The apex court ordered that the certificate of return be withdrawn immediately from the governor and his deputy and be issued to the candidate with the second highest votes in the Nov. 16, 2019 election.

The apex court held that the nomination form Degi-Eremieoyo submitted to INEC for the purpose of the Nov. 16, 2019, governorship election in the state, contained false information of fundamental nature.

The People’s Democratic Party (PDP) had asked the court to regard the discrepancies in Degi-Eremienyo’s certificates as major impediments to his candidacy.

They accused the All Progressives Congress (APC) running mate of providing different names at all levels of his education.

The PDP alleged in its case that Mr Degi-Eremienyo’s name was written as Degi Biobara in his primary school certificate, the documents from his secondary education bore Adegi Biobarakumo, as his name, while that of his university education had Degi Biobarakuma as his name.

Also, the result from his MBA certificate had Degi Biobarakuma Wangaha as the name of the same person.

The Court of Appeal in Abuja had dismissed the PDP’s case and affirmed the candidacy of the deputy governor-elect in the Nov. 16, 2019 governorship election in the state.

The judgment set aside the Nov. 12, 2019 verdict of Justice Inyang Ekwo of the Federal High Court in Abuja disqualifying Degi-Eremieoyo as the APC’s deputy governorship candidate in the poll.

The Appellate court held that the Federal High Court judge erred in his decision disqualifying the APC’s deputy governorship candidate.

It held that there were not enough grounds for the Federal High Court to rule the way it did, adding that the allegation that Degi-Eremienyo gave false information to INEC was not proved as required.

It faulted the lower court’s reliance on Section 31(5 and 6) of the Electoral Act in disqualifying the APC’s deputy governorship candidate.

The court added that the allegations against Degi-Eremienyo were criminal in nature which required proof beyond reasonable doubt.

It said that the different names contained in the appellant’s Form CF 001, his First School Leaving Certificate and General Certificate of Education belonged to the same person, going by the supporting affidavit of change of name and newspaper publication.

The appellate court therefore set aside the Federal High Court’s judgment, and awarded N500, 000 cost against the respondents in favour of the appellants.

The Federal High Court had in its judgment held that Degi-Eremienyo gave false information to INEC about his academic qualifications allegedly evidenced by the discrepancies in the names contained in his credentials.

The trial court also held that the names on the different documents attached to his Form CF001 were said to be, Biobarakum Degi-Eremienyo, Degi Biobaragha, Degi Biobarakuma, Adegi Biobakunmo, Degi-Eremienyo Wangagha.

The APC’s candidate was said to have claimed to have obtained “his First School Leaving Certificate in 1976” and presented to INEC “a First Leaving School Certificate of one Degi Biobaragha other than the one bearing his name Biobaragha Degi-Eremieoyo as shown in his INEC Form CF001.”

He was also said to have claimed to have “obtained his West African Examinations Council General Certificate of Education in 1984” and presented to INEC, “a GCE certificate of one Adegi Bibakuo other than the one bearing his name Biobarakuma Degi-Eremieoyo as shown in his INEC Form CF001.”

Justice Ekwo held that there was no evidence to prove that the documents with different name variations were his.

He ruled, “I further hold that the information given by the 3rd defendant on Form CF.001 that the documents thereto attached as his have not by any iota of credible evidence been so established.

“The information is false in all material particular as none of the said documents have any nexus with the name of the 3rd defendant (Degi-Eremienyo) on the said Form CF001.”

The judge went on to make a declaration “that the information which the 3rd defendant submitted to the 2nd defendant in his INEC Form CF001, that, affidavit in support of personal particulars of person seeking election to the office of the Deputy Governor of Bayelsa State is false contrary to section 31(5) of the 2010 Electoral Act (as amended).” (NAN)

As a chieftain of the APC, what was your reaction when you received the news of the sacking of David Lyon by the Supreme Court less than 24 hours before his inauguration as governor?

I warned about this development some few weeks ago. I said that Oshiomhole is doing more harm than good for APC. I said he is too combative and a troublemaker who thinks he knows more than everybody. This is not Labour movement, this is politics. His recklessness is what is leading APC into this problem that is happening now. Why must we win elections and then lose it to the opposition? We lost Zamfara, Rivers and now Bayelsa through carelessness. The deputy governorship candidate of APC in Bayelsa has no certificate but because he was brought by Minister of State for Petroleum Resources, anything goes. The party leadership led by Oshiomhole failed to do due diligence and background checks. Prof . Itse Sagay attacked him for being too troublesome and that his actions will kill the party but he blackmailed the old man saying he (Sagay) asked him to contest for presidency so as to present him in bad light to Buhari. Sagay had to say he asked him to contest against former president Olusegun Obasanjo in 2003 and not against President Buhari. Now we have lost Bayelsa, if they like let them gamble with Edo. We are waiting for them.

President Muhammadu Buhari few days ago reconstituted the reconciliation committee of the APC. As a leader in Edo state where the reconciliation committee will have a lot of work to do, are you comfortable with the latest development?

I think it is a welcome development. Though I have my reservations about it but the governor of the state, Godwin Obaseki who is the party leader in the state has issued a statement that he is happy about it. I agree with him because someone leading others through the river knows where it is the deepest. The governor is our party leader and we abide by any position taken by him. If he said the newly reconstituted committee is fine, then it is okay by me even though like I said, I have my reservations about it.

Recently there has been report s of explosions in some parts of Benin, the Edo state capital ahead of the elections. What do you think is responsible for this and how can it be nipped in the bud?

I am not too comfortable hearing about explosions here and there but at the end of the day, I think it is something that is being done by a group of people to achieve an end which is to give a wrong impression about Edo state. We are not a violent people and there have never been political killings in any of our elections in this state. In legal terms, I think what is happening is what is called compelling action by intimidation. They are trying to intimidate the powers that be to do certain things. Opposition to Obaseki has never been this violent. The Edo People’s Movement (EPM) led by Adams Oshiomhole and his boys have always been there and it was clear ab initio that their aim is not to give Obaseki a second term ticket and they made it quite clear. Though they were abusing the governor and holding rallies, there was no violence. But the whole thing changed when a decampee from PDP joined the APC and that is Osagie Ize-Iyamu. The whole plot is to remove Obaseki at all cost. First of all, they tried the National Assembly to take over the functions of the Edo state House of Assembly but the Edo state government was able to get a court order stopping them. Then, 14 of the lawmakers-elect loyal to them have already been quarantined in Abuja as Internally Displaced Politicians (IDPs). Their hope was that if the national assembly is able to take over the House, these 14 lawmakers will come back to Edo state and impeach the speaker and later go after the governor. After that one failed, they started burning markets and so on. People may start asking, why is all these taking place? The whole idea is to force the federal government to declare state of emergency. That was why I used the word ‘compelling action by intimidation. But they have also failed in this aspect too.

For those of you supporting Governor Obaseki, some people have claimed that you are just egging him and on and will dump him by the time the election heat starts in Edo state. What is your reaction to that?

I stand like the Rock of Gilbratar behind Godwin Obaseki. Nothing will make me leave him. I support him. I am doing that because he is doing the right thing. People don’t like change. For you to make an omelette you must break the egg. Things must go very tidy before we get to the next level. I am convinced that Godwin Obaseki knows what he is doing because I have known him from the age of 11 years. I have said it on so many fora that my relationship with him is not politics. I was his senior at college. I was in Class 5 while he was in Class 1. He is not just somebody that I am just knowing. I knew him from home before he came to join us in college. You can be rest assured that I know the person that I am talking about. He knows what he is doing. He is very straight forward and focused. Nobody can bend him. I have tried all the tricks in the book. But it is what he wants to do that he does. What’s happening now is like a storm in a teapot. There is a no cause for alarm. Be rest assured. I know many of us are still standing between the line. But don’t be bothered, don’t be shaken. Obaseki must do his eight years. If anybody, by error, omission and commission stops him, APC is dead in Edo State.
