JUST IN: Court dismisses rape allegation against Fatoyinbo, awards N1m against Busola

A High Court of the Federal Capital Territory, sitting at Bwari, Abuja has dismissed the sexual assault case filed by Busola Dakolo and exonerated Fatoyinbo.

This came after Fatoyinbo’s legal team filed an Objection and an affidavit at the Court reiterating that Busola’s statements were false and concocted to embarrass, scandalise and ridicule Fatoyinbo.

He averred that from the inception she sought the attention of the media and press, and brought the civil action even while the Police investigation was ongoing. Her false claim were stale and an abuse of judicial process.

The court held that the matter amounts to injustice, and an abuse of judicial process and held that the case is purely sentimental, empty.

The court awarded costs of N1,000,000 against Busola Dakolo and held that it would have been 10 times more but resisted it because there are women with legitimate claims who may approach the court. The Court held that the case carries more of cruelty in them than justice.

Segun Awosanya a.k.a Segalink who was one of those that stood up for Busola Dakolo following the controversy her rape allegation against Pastor Biodun Fatoyinbo ignited, has confirmed that she lost the court case against the Commonwealth of Zion Assembly (COZA) founder. 
 
According to the activist, Busola and Timi Dakolo received a call last night from their lawyers about the judge’s ruling on the preliminary objection today November 14.
 
According to Segalink, the court which awarded damages against the celebrity photographer while declaring the matter was statute barred because it happened a long time ago, had twice claimed that it cannot find processes on Busola Dakolo vs Biodun Fatiyinbo's case.

Fatoyinbo: Busola Dakolo vows to appeal court judgement

Popular celebrity photographer Busola Dakolo has vowed to appeal the ruling of Justice O. A. Musa of the Federal Capital Territory High Court in Abuja dismissing her rape allegation against Pastor Biodun Fatoyinbo of Commonwealth of Zion Assembly (COZA).
Her lawyer, Pelumi Olajengbesi, declared this in a statement.

He said: “We have received several calls after the ruling of the high court of the Federal Capital Territory sitting at Bwari this morning seeking our view on the decision of the court, hence, this statement.

“The court ruled that the matter is statute-barred because the events that crystallised to the cause of action took place 16 years ago and that the claimant Mrs. Busola Dakolo has only six years within which to seek redress in court in line with the statute of limitation.

“We are mindful of the decision as delivered by the court, presided over by the Hon. Justice A.O Musa.

“We are equally observant of the fact that the Court omitted to address the cause of action, the subject matter of the suit in determining whether it has jurisdiction to entertain the said matter.

“While we acknowledge the time of the court, we know in accordance with the Nigerian judicial system that the Court’s decision is not final as it is glaringly contestable.

“For all intent and purposes, having seen several sponsored misleading news reports in the media, we are duty-bound to state that the court has not and did not exonerate Biodun Fatoyinbo. As it stands, the substance of the matter has not received any judicial attention.

“Biodun Fatoyinbo through his lawyers has only argued that the court should not allow the matter to proceed to trial because it is an event that occurred long ago and hence out of time.

“We shall therefore in this circumstance approach a superior court to intervene for a better appreciation, and take a more expansive view of the suit considering that the subject matter is one that is novel in our clime.”

Tonto Dikeh Tells Fatoyinbo What To Do With Busola Dakolo N1million Fine




Actress Tonto Dikeh has advised COZA pastor, Biodun Fatoyinbo, to use the Busola Dakolo N1million fine to feed the Internally Displaced Persons, IDPs.

A Federal High Court sitting in Abuja threw away the case against Fatoyinbo which was filed by Busola Dakolo. She had claimed in an explosive interview early this year that the clergyman raped her twice when she was 17.

According to the court, the case was empty and full of sentiments which was a waste of its time. Busola Dakolo got fined N1million which will be given to Fatoyinbo, a sum which the court said should have been way more than that.

Reacting to the court’s verdict, Tonto Dikeh who had shown support for Fatoyinbo right from the explosive interview advised that the N1million should be used to feed IDPs.

COZA vs Busola Dakolo: ‘Cosby, R-Kelly took time’ – Bovi reacts to Fatoyinbo’s win

Popular Comedian, Abovi Ugboma popularly known as Bovi has rejected the court ruling in favour of Commonwealth of Zion Assembly, COZA, Pastor, Biodun Fatoyinbo on Thursday.

DAILY POST reported yesterday that in his ruling, Justice Oathman Musa of the Federal High Court in Abuja, held that the matter against Fatoyinbo amounted to injustice and an abuse of judicial process; adding that the case was empty and purely sentimental.

The judge further explained that the case was aimed more at cruelty than at obtaining justice.

The court also awarded costs of N1m against Busola Dakolo and held that the fine should have been 10 times more because the court’s time was wasted.

Dakolo has vowed to appeal the court’s decision. 

Reacting to the court ruling, Bovi compared the rape allegation against Fatoyinbo to that of R.Kelly and Bill Cosby.
Bovi on his Twitter page wrote: “Cosby took time. R.Kelly took time. Is it not penis? It will rise again.”

Also Nollywood Actress, Kate Henshaw, reacting on her Twitter page said the truth about the rape allegations will still be revealed

She wrote: “There is nothing hidden under the sun, one day the truth will come out. It doesn’t matter how long.”

Also, Bill Cosby was sometime in 2018 sentenced to prison for sexually assaulting Andrea Constand in 2004.

Pastor Biodun Fatoyinbo prays for his accusers as he wins rape case against Busola Dakolo (read his statement)






Pastor Biodun Fatoyinbo has reacted to the court judgement which exonerated him of rape and also awarded N1m against his accuser, Busola Dakolo as damages. 
 
LIB reported earlier that Justice O. A. Musa who presided over the case said the rape allegation was sentimental, cruel, empty and an abuse of judicial process. He further stated that the damages awarded against Busola Dakolo should be 10 times higher but was reduced in order not to discourage others who have legitimate claims. 
 
Pastor Fatoyinbo in a statement released on his behalf by his Senior Executive Assistant Pastor Ademola Adetuberu, dedicated his victory to God and those that stood by him.
 
According to him, the enemies of the church wanted to use him as a scapegoat. The Commonwealth of Zion Assembly (COZA) also prayed for his accusers, those that have been raped and those that have been wrongly accused. 
 

“The victory is of the Lord. We dedicate it to those who stand by us. The victory belongs to God not to me or COZA. We will not share in His glory. The enemies are after the Church and not after me per se.
“They only used me as a scapegoat to launch the attacks. We know that faithful is He who has called us.
“I salute the courage and the support of my beautiful and godly wife, my lovely children, members of COZA family and those who stand by us.
“May God be praised in your life. I bear no grudge against those who were used by the adversary of the Church but instead, I pray for them that we should come together to fight the common enemies of the Church.
“My soul goes to men who are wrongly accused and women who are or have been abused. May God heal the wounds of everyone of us in Jesus Name,” he quoted the Pastor as saying.

CAN reacts to Fatoyinbo’s court victory, says image of the Nigerian church has been dented by the rape allegation






The Christian Association of Nigeria (CAN) has reacted to the court Judgement which struck out the rape allegation made by Busola Dakolo against Pastor Biodun Fatoyibo and also awarded N1m as damages in favour of the Commonwealth of Zion Assembly Founder. 
 
Pastor Bayo Oladeji, media aide of the President of Christian Association of Nigeria Revd Samson Ayokunle who spoke to Vanguard on his behalf, said the image of the Nigerian church has been dented by the rape allegation and the court proceedings. 
 
The CAN President also urged Pastor Biodun Fatoyinbo and Busola Dakolo to put away all that happened and reconcile. 
 

“While we note that the image of the Nigerian Church and its leadership was dented before and during the court proceedings, CAN urges Pastor Fatoyinbo and Mrs Dakolo, to put away all that has transpired and reconcile.
“The Church preaches forgiveness and reconciliation, and that is our position as the umbrella body of Christians in the country.
“We begrudge neither Pastor Fatoyinbo nor Busola Dakolo, and urge them to extend a similar hand of love and fellowship to each other" he said.

Daddy Freeze has commented on report of Busola Dakolo losing the rape case against Pastor Biodun Fatoyinbo and also being fined N1m as damages. 
 
The Cool FM OAP who shared his thoughts on the rape saga via a live video, told women not to go public with their rape allegation if they don't have a good story. He stated that he has 3 sons and don't want them in jail because a woman has a story. 
 
Daddy Freeze insisted that if one doesn't have what it takes to nail an offender properly, they should "shut up" as it all amounts to "audio doings".  He added that he will never undermine the pain of a woman but won't encourage putting a man in pain either.

Pastor Matthew Ashimolowo, senior pastor of Kingsway Christian Center in London who was one of those listed as witnesses by Busola Dakolo in her court papers was a guest preacher at COZA church this morning.
 
The popular Pastor preached against the accusers of COZA senior pastor, Biodun Fatoyinbo and also fired up prayers against them.
 
Ashimolowo thanked God for the recent victory of Fatoyinbo, decreeing that the members of the church would also experience victories in their lives.
 
The clergyman while preaching described ‘Fault Finders’ as a set of people who do not want Christians to make it in life. He said Biodun Fatoyinbo has four things- Calling, Committment, Consencration and Covenant with God and that for anyone to come against him, they have to contend with these four things as Fatoyinbo, did not gatecrash but was ''called into the Ministry.''
 
The clergyman warned against jumping on every topic that is being discussed on social media. According to him, it is great to be on social media but it can also become the sword that kills a person. 
 
Ashimolowo said another thing that can attack a Christian is Satanic accusers. According to him, Satanic accussation always goes before Godly promotion. He said Potiphar's wife brought an accusation against Joseph but she didn't realise that instead of stopping him, it lifted him. The clergyman reminded the congregation of how Portiphar's wife had to come bow before Joseph who she falsely accused a while back.
 
He also listed Satanic condemners as people that attack Christians. According to him, because people use what they know against you doesn't mean it stands against you. 

“I may have even done what you said I did but I am not the man whom you say I am'' he said as Biodun Fatoyinbo and others listened.
