Deji Adeyanju, leader of civil society organisation, Concerned Nigerians, has asked the United States Embassy in Nigeria to impose visa ban on Cross River State governor, Ben Ayade, over the illegal arrest and detention of Nigerian journalists, Agba Jalingo and Joseph Odok.
 
In a letter addressed to the embassy and signed by Adeyanju, the group said it believes that the illegal arrest and detention of Jalingo and Odok shouldn’t happen in a democracy. Both journalist have been in detention for allegedly writing articles against the governor. 
 
Part of the petition letter signed by Deji Adeyanju reads
Quote:“This trend of despotism without consequences will only aggravate the worsening human rights condition in the country. We write to call the attention of the United States Embassy in Nigeria to the unabashed clampdown on press freedom and freedom of expression in Cross River State.
Governor Ben Ayade has declared war on press freedom and free speech in the state by randomly harassing, arresting and incarcerating activists and journalists on fallacious charges to abet his repression and persecution agenda.
“We therefore beseech you to please look into these human rights violations going on in Cross River State and impose visa restrictions on Governor Ayade and all members of his family.
“We trust that the United States Government will demonstrate to Nigerians, once again, as was done to those that undermined Nigeria’s electoral and democratic process in the 2019 general elections, that it is strongly opposed to human rights violations, acts of injustice and undemocratic practices by persons in positions of power in Nigeria.”
 
The group in another petition to the National Human Rights Commission, urged the agency to commence investigation into the growing clampdown on press freedom and freedom of expression in Cross River State.

Terrorism charges against lawyer detained for "criticizing Governor Ben Ayade", withdrawn by Police

The terrorism charges against Joseph Odok, a lawyer and a known critic of Cross River governor, Ben Ayade has been withdrawn by the Nigerian Police. 
 
In a motion filed before the Federal High Court in Calabar by the Prosecution Counsel Dennis Tarhemba on Tuesday October 29, the police said they are withdrawing the terrorism charges against Odok because its headquarters in Abuja wants the case transferred to them for further investigation. 
 
However the Justice Simon Amobeda who commented on the move to withdraw the terrorism charges against Mr Odok who is also charged with cybercrime for allegedly accusing the chief of staff to Mr Ayade of being a cultist, stated that only the attorney general of the federation has such powers.  It is expected the court will rule on the motion on November 6.
 
Premium Times reported that Ayade’s spokesperson, Christian Ita denied the governor’s involvement in the arrest and detention of Mr Odok.
 
Quote:“It’s wrong for people to describe as the governor’s critic, anyone arrested by the police. The governor does not know anything about his arrest, the police are in a better position to tell you why they have arrested him,” Mr Ita said.

I think Agba Jalingo should be released – Governor Ben Ayade says as he denies ordering the journalist's arrest

Governor Ben Ayade has expressed his desire to see the publisher of Cross River Watch, Agba Jalingo being released months after being arrested and arraigned on charges of treason. 
 
The Cross River State Governor who denied having a hand in the arrest and trial of the journalist, alleged that Agba Jalingo is being prosecuted by the Federal Government. 
 
Speaking to newsmen after a meeting with President Buhari at the state house in Abuja on Monday January 27, Ayade accused Jalingo of leaving journalism to meddle into politics as he disclosed that his arrest and trial is connected to Omoyele Sowore’s #RevolutionNow protest. 
 
He added that after Jalingo joined the protest, he stopped being seen as a journalist but as someone who is plotting to overthrow President Buhari's government. 
 
Ayade said; 
 
Quote:“In court, it is Federal Government versus Agba Jalingo, not Cross River State.  He’s in court for treason, a state does not have the power to try anyone for treason, it’s not me.
“On his Facebook page, he sent pictures where he was being teargassed at the revolution march in Lagos. His own pictures, posted by himself and when Sowore was being arrested, he went back to his Facebook to post that the revolution has just started, ‘we will continue this battle until revolution works’. He admitted this in Court.
“You are seeing him as a journalist, but he’s not, he’s the chairman of Sowore’s party in Cross River State so he’s a politician. He has a primary calling, which is journalism.
“Once he started the campaign to overthrow the government of President Buhari, he ceased to be seen from the point of a journalist because he has become the state chairman of a party. ”
 
The Cross River State Governor also blamed the journalist's activism on youthful exuberance as he expressed desire to see him released. He also claimed that he is working with Jalingo's lawyer to secure his release. 
 
Ayade added; 
 
Quote:“I am of the opinion that Agba should be released because I think he was just youthfully excited.
“If you ask Agba Jalingo today, I am the one working with his lawyers for his freedom, I am the one sustaining him and sending upkeeps."
 
Before Ayade's recent comment, it was reported that Agba Jalingo is standing trial over his report which suggested that the Cross River State Governor diverted N500 million meant for the state. His trial was on November 2019 listed among 10 “most urgent” cases of threats to press freedom around the world.

“In court, it is Federal Government versus Agba Jalingo, not Cross River State,” Mr Ayade told reporters on Monday at the presidential villa, Abuja, where he went to meet President Muhammadu Buhari.

“He’s in court for treason, a state does not have power to try anyone for treason, it’s not me.”

Mr Ayade said the journalist’s arrest and trial is in connection with Omoyele Sowore’s #RevolutionNow protest.

“On his Facebook page, he sent pictures where he was being teargassed at the revolution march in Lagos. His own pictures, posted by himself and when Sowore was being arrested, he went back to his Facebook to post that the revolution has just started, ‘we will continue this battle until revolution works’. He admitted this in Court,” Mr Ayade said.

Governor Ayade, however, says he has been working for Mr Jalingo’s release from Calabar prison where he has been incarcerated.

“If you ask Agba Jalingo today, I’m the one working with his lawyers for his freedom, I’m the one sustaining him and sending upkeeps,” he said.


PREMIUM TIMES contacted Mr Jalingo’s lawyer, Attah Ochinke who said, “I can confirm I have been in discussions with officials of the Cross River state government in that direction (Jalingo’s freedom).

Mr Ochinke said he would not comment on Mr Ayade’s claims that he has been sending “upkeeps” to the detained journalists. “It is not through me,” he said.


The governor spoke on his relationship with Mr Jalingo whom he said is his “brother”. He said the journalist betrayed him after he assisted him and his newspaper. He accused the journalist of serial acts of “blackmail”.

“Please don’t get it wrong, Agba Jalingo is not just from Cross River State, he’s not just from Obudu, where I also come from, he’s my brother.

“Please ask Agba Jalingo, that CrossRiverWatch, the first person to give him money to set up the office was myself. His official vehicle, it was me. I don’t have to list all of these, he knows that I have funded and supported him, but journalism stops where blackmail becomes part of your strategy.

“Today you need something, then Ayade is a good man and you start writing all the good things, but if I take my phone and show you our WhatsApp communication, you will call me a godly man. Today I need money to set up a computer school, tomorrow I need money to feed my birds, the other day I need to be INNOSON’s sole distributor in Cross River State, I do all that.

“But when I don’t get a thing right you go to the social media and write something as careless as Governor Ayade has taken N500 million to Russia. You impugned my father’s name, my character, my family name, for just a personal request that I’ve not met, out of many that I have met.

“Please for once, put yourselves in my shoes. All I simply did was to stay out of the issue,” the governor said.

“I have an intellectual background as a professor, I will stand with journalists at all times and I will never prosecute somebody.”

Socio-Economic Rights and Accountability Project (SERAP) has dragged the government of Nigeria and Cross River state government of governor Ben Ayade to ECOWAS Court of Justice in Abuja “over the prolonged, arbitrary detention; unfair prosecution; persecution, and sham trial of journalist Agba Jalingo.”

Jalingo, who is the publisher of CrossRiverWatch, was arrested on August 22 over a report alleging that Mr Ayade diverted N500 million belonging to the state.

In the suit number ECW/CCJ/APP/10/2020 filed last week at the ECOWAS Court, SERAP is arguing that: “The sole objective of the government of Nigeria and the Cross River state government of governor Ben Ayade is to perpetually keep Agba Jalingo in arbitrary detention and to silence him simply for expressing critical views and carrying out his legitimate job as journalist.”

According to the suit: “This is not the first time the government of Nigeria and the Cross River state government of governor Ben Ayade have taken actions to intimidate, harass and suppress journalists through the instrumentality of trumped-up charges and use of overly broad and unjust laws, including section 24 of Nigeria’s Cybercrime Act, 2015, which provides for the offence of cyber-stalking.”

The suit filed on SERAP’s behalf by its solicitor Kolawole Oluwadare, states: “the government of Nigeria and Cross-River state government are using vague laws that give officials massive discretion to undermine human rights. They are punishing Agba Jalingo and other journalists and silencing them for their reporting, thereby undermining Nigerians’ right to information, to public participation, to open and democratic governance in the country.”

The suit read, in part: “If freedom of expression and media freedom are to have true meaning in a democracy, these rights necessarily must include the freedom to criticize the government and its functionaries. Indeed, the idea of a democracy is that the people are encouraged to express their criticisms, even their wrong-headed criticisms, of elected government institutions, in the expectation that this process will improve the process of government.”

“The harassment, intimidation, unfair prosecution and arbitrary detention of Agba Jalingo simply for exercising his human rights violate Nigeria’s international human rights obligations, including under the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples’ Rights to which the country is a state party.”

“Freedom of expression is a fundamental human right and full enjoyment of this right is central to achieving individual freedom and to developing democracy. It is not only the cornerstone of democracy, but indispensable to a thriving civil society”

“In circumstances of public debate concerning public figures in the political domain and public institutions, the value placed by human rights treaties upon uninhibited expression is particularly high.”

“The government of Nigeria and the Cross-River state government of governor Ben Ayade have via the charges of terrorism and treason and denial of bail to Agba Jalingo, violated and continued to breach his human rights.”

“SERAP contends that Agba Jalingo is being unfairly prosecuted because of his reporting in his online news outlet, Cross River Watch, which alleged that the Cross Rivers State Governor diverted the sum of N500 Million, belonging to the Cross-River Micro Finance Bank.”

“On 22nd August 2019, the Nigeria Police, through its special anti-robbery squad arrested Agba Jalingo. On 23rd August 2019, Mr. Jalingo was transferred to a detention facility run by the anti-cult and anti-kidnapping police in Calabar, the capital of Nigeria’s southern Cross River state and was held there for days before his arraignment on 31st August, 2019.”

SERAP is seeking the following reliefs:

1. A DECLARATION that the actions by the government of Nigeria and the Cross River state government of governor Ben Ayade to continue to arbitrarily detain and unfairly prosecute Agba Jalingo using the Cybercrimes Act, sections 41 & 59 of Nigeria’s Criminal Code Act and sections 1 & 17 (2)(a)&(b) of the Terrorism (Prevention, Amendment) Act, violate his human rights, as guaranteed under the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples’ Rights

2. A DECLARATION that the arbitrary detention and unfair prosecution of Agba Jalingo by the government of Nigeria and the Cross River state government of governor Ben Ayade is illegal and unlawful, as it amounts to breaches of Nigerian international obligations to respect, protect, promote and fulfil the rights to freedom of expression and information and media freedom, guaranteed under the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples’ Rights

3. AN ORDER directing the government of Nigeria and the Cross-River state government of governor Ben Ayade to immediately and unconditionally release Agba Jalingo and drop all charges against him, consistent with Nigeria’s international human rights obligations under the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples’ Rights

4. AN ORDER directing directing the government of Nigeria and the Cross-River state government of governor Ben Ayade and/or their agents to provide Agba Jalingo with effective remedies and reparation, including adequate compensation, restitution, satisfaction and guarantees of non-repetition

5. FOR SUCH FURTHER orders as the Honorable Court may deem fit to make in the circumstances of this suit.

No date has been fixed for the hearing of the suit.

The prosecution of journalist, Agba Jalingo took another twist on Thursday morning as the Cross River State government has reverted to the initial charges of treason, terrorism, cultism and attempt to topple the Cross River state government against him.

Jalingo was docked before Justice Sule Shuaibu of the Calabar division of the Federal High court for the first time after former trial Judge, Simon Amobeda recused himself.

And, when the matter was called up for Jalingo to take a fresh plea on the amended charges filed on October 11, 2019 which bordered on three counts of terrorism and one count of cybercrime, the Judge discovered that a clean copy was not filed by the former prosecutor, Dennis Tarhemba.

Despite the explanation given by the defense counsel that both parties have relied on the copy of the charge used as an annexure to the motion to amend charges, Justice Shuaibu said it was not a proper process filed before the court and can not stand on it’s own.

Taking the hint of the court, the prosecution counsel and Attorney General of Cross River State, Tanko Ashang said they will rely on the initial charges filed on August 30, 2019 which included charges of treason, terrorism, cultism and attempt to topple the Cross River state government.

Jalingo pleaded not guilty to all the charges.

The matter is still ongoing with the defense counsel expected to move the motion for bail.

Agba Jalingo Finally Released From Detention (Video)



IgbereTV reports that, Agba Jalingo, the journalist charged with conspiracy, terrorism, treasonable felony and an attempt to topple the Cross River State Government has finally been released from detention after perfecting his bail condition on Monday.

Earlier, he was granted N10million bail by the Federal High Court in Calabar, the Cross River State Capital.

IgbereTV recalls that jalingo was arrested on the orders of Cross River State governor, Ben Ayade, after he raised questions on the whereabouts of N500m meant for the establishment of Cross River Microfinance Bank.

Agba Jalingo regains freedom after 6 months in prison (photos)

Agba Jalingo, the publisher of Cross River Watch has regained freedom after spending 6 months in prison. 
 
Recall the journalist was charged with conspiracy, terrorism, treasonable felony and an attempt to topple the state government after he published a story of how Governor Ben Ayade of Cross River allegedly approved and diverted N500 million meant for the state’s microfinance bank.
 
Jalingo who was granted a N10 million bail by a federal high court in Calabarwas released today February 17 after perfecting the bail conditions. 
 
Nigerian lawyer, First Baba Isa who shared a photo of him driving the journalist out from prison wrote;
