CJN Suspension: Our Democracy Is On Fire - House Of Reps Speaker, Dogara

The Speaker of the House of Representatives, Yakubu Dogara has weighed in on the recent suspension of the Chief Justice of Nigeria, Walter Nkanu Onnoghen by President Muhammadu Buhari.

Dogara, in a statement made available to PoliticsNGR, raised alarm that Nigeria's democracy was 'on fire'. The Statement read;

"With the unconstitutional suspension of the Chief Justice of Nigeria (CJN) by President Muhammadu Buhari, the world has been served with notice that Nigeria is now a full-blown dictatorship. This did not come as a rude shock except to those that have been blind to the gradual but progressive erosion of democratic values in the polity as President Buhari’s Government has never hidden its disdain for the rule of law."

"We have watched in disbelief as the Government recklessly deploys institutional prerogatives; routinely flouts the rule of law; subverts and assaults democratic Institutions; refuses to accept opponents as legitimate; suppresses citizens civil liberties(especially those of opponents) and trample underfoot the media. In short, the Government’s tyrannical and authoritarian credentials are loathsomely legendary."

"No provision in Sections 157 and 292 of the 1999 Constitution as amended supports the President in purporting to suspend the CJN or swearing in an acting CJN. The whole idea of a limited government is that the President’s powers is limited by law and it is ultra vires his powers to act in the absence of explicit legislative authorization. That is representative democracy at its best which our 1999 Constitution as amended guarantees."

"It is instructive to note that our Constitution does not contemplate or presupposes a situation whereby the Judiciary will have a suspended CJN and an acting CJN at the same time. Therefore, it is right to posit, as some have done that the President now has his own Chief Judge to do his bidding while Nigeria has a sitting CJN until he is removed in line with the provisions of the Constitution."

"The awfully crude annexation of the judiciary by the President in violation of his oath of office and the Constitution cannot be for any other reason except, as alleged by so many, to prepare the judiciary ahead of time for the purpose of conferring some aura of legitimacy to the contraption that the 2019 general elections may after all become."

"I therefore call on the President to remember that he has no better legacy to bequeath other than a good name: which cannot be achieved without honour, character and integrity. Honour and integrity demand that he upholds his oath of office by reversing this assault on our Constitution and following the manifestly clear and unambiguous constitutional procedure for the removal of the CJN if he must be removed. Anything short of this demeans all of us."

"To our citizens, we must now head the warning of the Irish lawyer cum orator, John Philpot Curran who said, “the condition upon which God had given liberty to man is eternal vigilance: which condition if he breaks, servitude is at once the consequences of his crime, and the punishment of his guilt”. Despotism can only prosper in Nigeria if good men and women do nothing."

"I also call on all lovers of freedom and democracy all over the world to rise to the occasion and demand of this Government and the President to halt the march to anarchy and bedlam: which dictatorship promotes. The world has an experience in this and it must not allow this unmitigated disaster on Nigeria before it acts to restore sanity."

"As of today, Nigeria is now Germany in the wake of the 1933 Reichstag fire. Our democracy is on fire; ignited by the very people who swore to protect and defend it. That this fire must not convert the Chancellor to Fuhrer as it happened in Germany in 1933 depends on our collective response and that of the international community. We must not bow our knees to dictatorship: not now, not ever again."

Onnoghen: Presidency wants to truncate Nigeria’s democracy – Ortom

The Benue State Governor, Samuel Ortom has said that the suspension of the Chief Justice of Nigeria, Justice Walter Onnoghen and his hasty replacement is an attempt by the presidency to truncate democracy and throw the country into anarchy.


Governor Ortom, in a statement issued by his Chief Press Secretary, Terve Akase, stated that by the unconstitutional sacking of the CJN, the presidency has demonstrated that it does not believe in the rule of law, due process and the principle of separation of powers.

He said the suspension of the CJN is not only a slap on the judiciary but the action also exposes the present administration’s desperate self-secession bid at the expense of the country’s unity and its continued existence.


The Governor wonders why the current administration which has no antecedent of respecting court orders acted swiftly relying on a ‘directive’ from the Code of Conduct Tribunal to suspend the CJN.

He said the hurried removal of Justice Onnoghen appears to have the imprints of the cabal which the president’s wife said is running the government.

Governor Ortom advises the presidency to remember that its integrity is at stake and should reverse the CJN’s suspension in the interest of the country.


The Governor stated that the All Progressives Congress administration has left no one in doubt regarding its agenda to manipulate the 2019 elections.

He called on all Nigerians to reject the illegal removal of CJN Onnoghen and every other attempt by the ruling APC to cause constitutional crisis in the country.

The senator representing Kogi West district in the National Assembly, Dino Melaye has accused President Muhammadu Buhari of destroying democracy in Nigeria.


Melaye in a post on his Twitter page titled, “THE AUDACITY OF BAD LEADERSHIP IN NIGERIA,” urged Nigerians to stand up against the government and stop ‘evil audacity’ in the country.

Making reference to Buhari’s regime in 1983, Melaye said “Buhari in 1983 destroyed Democracy in Khaki and today in 2019 is assaulting Nigerians in babariga.


“Man dies only once,Nigerians! we must all come out of our cocoons and stop this display of evil audacity.

“Government is not owned by those in Government but owned by the People. Nigerians must prove that the people are bigger than those in Government. The time to act is NOW!!

Buhari has since Friday been under criticisms after he suspended Chief Justice of Nigeria, Walter Onnoghen based on an order of Code of Conduct Tribunal, CCT.

A chieftain of the apex Igbo socio-cultural organization, Ohanaeze Ndigbo, Mazi Chuks Ibegbu, has warned the federal government not to cause crisis in the country by the growing impunity in the polity.
Ibegbu noted that the suspension of the Chief Justice of Nigeria, Walter Onnoghen was one of the evidences that Nigeria was gradually sliding into preventable anarchy.

Akelicious had reported on Friday, that President Buhari, acting on an order from the Code of Conduct Tribunal, CCT, suspended the CJN.


The President immediately swore in Ibrahim Tanko Mohammed from Bauchi state as the Acting CJN.

The Ohanaeze chieftain, who gave the warning, while reacting to the suspension of the CJN, in a chat with DAILY POST on Saturday, wondered why the CCT Chairman, Justice, Tanko Danladi who is still not cleared for corruption charges, would have the audacity and temerity to recommend the suspension of Justice Onnoghen.

Ibegbu, who is also the deputy National publicity secretary of Ohanaeze Ndigbo, called on all Nigerians of goodwill and the international community to intervene in “this executive rascality, before Nigeria is embroiled in total civilian dictatorship.”


“Nobody is above the law, but due process has to be followed. And the office of the Chief Justice of Nigeria is not among those that should be trivialised by the Executive arm of
government.”

He also called for the immediate reinstatement of Onnoghen to save the nation’s democracy from total collapse.

Onnoghen: PDP House Of Reps Back CJN, Blast Buhari For Being Desperate

Members of the House of Representatives elected on the Peoples Democratic Party, PDP, platform, have vowed to stand together to fight anti-democratic forces desperate to subvert Nigeria’s constitution.

This was contained in a statement signed by the Deputy Minority Leader, Chukwuma Onyema, and issued to reporters on Saturday.

The PDP Caucus condemned the forceful suspension of the Chief Justice of Nigeria ,CJN, Justice Walter Onnoghen by President Muhammadu Buhari

The statement read, ”It is no surprise that within a short while, President Muhammadu Buhari’s unprecedented unilateral replacement of Justice Walter Onnoghen with Justice Tanko Mohammed has reverberated so loudly across the world; so has news of how Onnoghen’s residence was unjustifiably blanketed by forces of coercion during the weekend.

“We note too, that the United Kingdom, the European Union Election Observation Mission (EU EOM) and the United States have joined their voices with that of credible and progressive Nigerian democrats, legal professionals and civil society in expressing very deep concerns over the constitutionality or lack thereof, of the Presidency’s suspension of the chief officer of the judicial arm.

“With less than 20 days to the presidential and National Assembly election and with few hours to the constitution of election tribunal judges done on Saturday, the APC/Buhari administration has unequivocally shown its determination to use sleight of hand methods in forcing an election win by all undemocratic means possible.


“As many have rightly noted, the hurried timing of the action, so close to the next election suggests a hidden and perverse agenda by a government that lives in an echo chamber of self-adulation, promising change and transparency while perilously endangering democracy and short-circuiting due process.
Without citing any explicit constitutional authority and hiding behind ‘an order from the Code of Conduct Tribunal,’ President Buhari flagrantly violated the provisions of Section 292 (2) of the 1999 Constitution that clearly lays out how the Chief Justice of Nigeria can be removed from office Unequivocally, Sections 153, 158, and Parts 1 and 2 of the 3rd Schedule to the Constitution provide that a Judicial Officer cannot be so arbitrarily removed from Office until he has first been tried by the National Judicial Council (NJC) while Section 292 (2) makes it clear that the President can only remove the CJN from Office while acting on such decision reached by two-thirds majority of the Senate.

“Without doubt, theirs has been a government of lies, lies, propaganda and then more lies and every conscious Nigerian knows that the entirely contrived and hurried circumstances was orchestrated based on the so-called petition dated January 7 by President Buhari’s erstwhile aide, an APC man while another APC sympathizer is neck deep in the persecution case.

“Everyone in Nigeria knows how Justice Onnoghen’s substantive elevation to the CJN position was unduly delayed by the Buhari government in 2016 until reason prevailed and Osinbajo, as Acting President did the needful in 2017.

“When Buhari’s former aide’s January 7 petition came to light, they initially lied that the Presidency knew nothing about it but the exceedingly lightning speed put behind it all by the Buhari presidency speaks volumes.

“Even a Thursday Court of Appeal ruling, ordering the CCT to stay action, pending the determination of Onnoghen’s application that the CCT had no power to try him, was waved aside for President Buhari’s unprecedented decision of Friday, January 25!

“The military invasion of Daily Trust newspaper, disregard of court orders and non-release of the leader of the Islamic Movement in Nigeria, Ibrahim el-Zakzaky and his wife, Zinat since December 2015, flagrant disobedience of court orders for the release of former NSA, Sambo Dasuki on bail and this crude, anti-democratic arbitrariness on CJN Onnoghen only attest to fears that we are back in the era of President Buhari’s dark-goggled late ally, with loathsome memories of Buhari’s Decree 4 dictatorship era.

“The PDP Caucus of the House of Representatives hereby assures millions of law-abiding, democracy-loving Nigerians who have respect for process that we shall stand together against anti-democratic forces who are desperate to subvert Nigeria’s constitution, short-circuit the legal process and truncate our democracy out of sheer desperation to cling to power at all costs.”
